Do You Need a Gazette for a Name Change After Marriage in West Bengal? (Quick Answer)
Often no. There is no legal duty to change your name on marriage. If only your surname is changing and you hold a registered marriage certificate showing both names, Aadhaar, PAN, banks and the passport office usually accept it. You need a gazette when the certificate does not carry both names, when an office insists, when you are changing more than the surname, or when a foreign office wants the Government's own record. Then: Kolkata Gazette Part II (Annexure II, Rs 1,100 on GRIPS, within 7 days) for state records and IDs, or the Gazette of India (Rs 1,100 on BharatKosh, 30 to 45 days) for passport and out-of-state use.

| Fact | Path A: Marriage certificate | Path B: Gazette (state or central) |
|---|---|---|
| Best for | Surname only, registered marriage, certificate shows both names | Certificate lacks a name, office insists, more than surname changing, foreign use |
| Legal basis | Marriage certificate as proof of the changed surname | Published gazette notification |
| Government fee | None for the name change; each office's own update fee | Rs 1,100 state (GRIPS) or Rs 1,100 central (BharatKosh) |
| Time | Each office's own time | 7 days state; 30 to 45 days central |
| Newspaper | Not needed | One Bengali and one English daily |
| Affidavit | Not needed by most offices | Magistrate (state) or notary (central) |
| Passport | Reissue with the marriage certificate, spouse's name added | Reissue with the Gazette of India page |
| Can you revert later | Yes, either way; the Kolkata Gazette Part II expressly covers reversion to maiden name (guide) | |
Name Change After Marriage in West Bengal: The Rules in One Place
- Is it compulsory
- No. No law in India requires a wife to take her husband's surname. There is no deadline and no penalty for keeping your own name.
- Who may change
- Either spouse. A husband may take his wife's surname by the same process, with the same documents.
- When the certificate is enough
- A registered marriage certificate showing both the previous and the new name is usually accepted by Aadhaar, PAN, banks and the passport office for a surname change alone. No gazette in that case.
- When a gazette is needed
- When the first name changes too, when the certificate does not carry your previous name, when the marriage is unregistered, or when an office asks for a gazette in writing.
- State route
- Kolkata Gazette Part II, Change of Surname, Annexure II undertaking, affidavit before a First Class Judicial Magistrate, GRIPS fee Rs 1,100, notification within 7 days of a complete file.
- Central route
- Gazette of India Part IV, notarised affidavit, typed proforma with two witnesses, BharatKosh fee Rs 1,100, posted to Civil Lines, Delhi-110054, published on a Saturday in 30 to 45 days.
- Which route for a passport
- The Gazette of India. A passport is never edited; a name change is a reissue with a new booklet and a new number, and existing visas do not carry over.
- Newspapers
- One Bengali daily and one English daily circulating in your district, same text in both, complete original pages kept.
- Signature rule
- Every form and affidavit is signed in the old name. The married surname is not legal until the gazette is published.
- Aadhaar limit
- Two name changes in a lifetime, updated in person at a Seva Kendra. Settle the exact spelling of the married name before you apply anywhere.
- Address rule
- UIDAI expects the address on the gazette to match your Aadhaar address. If you moved after marriage, check the Aadhaar address before drafting the affidavit.
- Government employees
- A State Government employee changing only her surname on marriage is expressly covered by Kolkata Gazette Part II. A Central Government employee gives written intimation to the appointing authority for the service book, with no deed, newspaper or gazette needed for a surname alone.

Is It Mandatory to Change Your Name After Marriage in West Bengal?
There is no law in India that requires a woman to change her name or surname on marriage, and no deadline by which she must. Either spouse may adopt the other's surname, both may keep their own, or they may hyphenate. The choice is personal; the paperwork depends on which choice you make.
What the law does require is that whatever name you use on official records be provable. For a married surname there are two kinds of proof: the registered marriage certificate, which shows who you were and who you married, and a gazette notification, which is the Government publishing your declaration of the new name.
The honest test
Ask the office that has to accept the new name what it wants. Aadhaar, PAN, banks and the passport office usually answer "marriage certificate". A foreign employer, a university abroad or a board that wants an official record answers "gazette". Until you can ask, use Path A first; it costs nothing to try and the gazette can follow.
Surname Change After Marriage Without a Gazette: Marriage Certificate Only
When it works
- Your marriage is registered and the certificate shows your name and your spouse's
- Only the surname is changing; first name stays as it is
- The offices you need are Aadhaar, PAN, bank, voter ID, driving licence, employer
The chain, in order
Aadhaar
Seva Kendra with the marriage certificate and your current Aadhaar. New surname recorded. Two name changes in a lifetime, so settle the exact form first. Aadhaar guide.
PAN
Correction on the existing PAN with the updated Aadhaar and the certificate. Never a new PAN. PAN guide.
Bank, then the rest
KYC update with Aadhaar, PAN and certificate; fresh specimen signature if changed (bank guide). Then voter ID (Form 8, free; voter ID guide), licence, employer, insurance nominations.
Passport
Reissue with the marriage certificate to add the spouse's name and the new surname. New booklet, new number. Passport guide.
What it costs
No gazette fee, no newspaper, no affidavit. Only each office's own update fee, which is small; the voter ID correction is free.
Where it fails: an unregistered marriage, a certificate that shows only one name, a first name change bundled with the surname, or an office that refuses. Any of those moves you to Path B.
When a Gazette Name Change After Marriage Is Needed in West Bengal
Certificate lacks the name
Some certificates carry only the maiden name, or only one spouse's full name. An office cannot link old and new from it.
An office insists
Some boards, universities, PSUs and foreign employers want the Government's own record, not a certificate they cannot verify.
More than the surname
A new first name, a middle name dropped, or a spelling fixed at the same time is a change of name, not a married surname.
Unregistered marriage
Register it first if you can. If not, the gazette is the only formal proof, and the affidavit should state the marriage.
Use abroad
Embassies and overseas institutions accept the Gazette of India as the Government of India's record of the change.
Remarriage or reversion
The Kolkata Gazette Part II expressly covers surname change on remarriage and reversion to maiden name on divorce, separation or death of husband. Name change after divorce, step by step.
| Your need | Gazette | Why |
|---|---|---|
| Aadhaar, PAN, bank, state records | Kolkata Gazette Part II, Change of Surname, Annexure II | Online, Rs 1,100 on GRIPS, within 7 days |
| Passport, visa, job or study abroad | Gazette of India, Part IV | What the passport office and embassies look for |
| Both likely | Both | Same affidavit and newspapers; only the attestation differs |

Affidavit with both your father's and husband's names
On stamp paper, in your maiden name: "I, [maiden name], daughter of [father], wife of [husband], residing at [address], have changed my surname from [old] to [new] on marriage." Notice in one Bengali and one English daily
Same wording, showing old name, new name, husband's name and address. Keep the complete pages. These serve both gazettes.

Documents Required for Surname Change After Marriage in West Bengal
Path A: marriage certificate route
- Registered marriage certificate showing both names
- Current Aadhaar, PAN, bank passbook
- Photographs as each office asks
- For the passport: spouse's passport or ID, as Passport Seva lists
Path B: gazette route (either gazette)
- Affidavit in the maiden name with father's and husband's names and address; Magistrate-attested (state) or notarised (central)
- Complete newspaper pages, Bengali and English
- Registered marriage certificate
- Aadhaar, Passport or Driving Licence; address proof for domicile (state)
- Two passport size photographs
- GRIPS or BharatKosh receipt, Rs 1,100
- State: online undertaking in Annexure II. Central: typed proforma with two witnesses, soft copy and certificate
Husband's Surname, Hyphenated Surname, Keeping Yours, or Husband Taking Yours
Take the husband's surname
The common case. Path A usually works; Path B under Change of Surname if needed.
Hyphenate or add, keep maiden
"Sen-Roy" or "Sen Roy". Some offices treat this as a change of surname needing a gazette, because the certificate does not show the combined form. Plan for Path B.
Keep your own name
Nothing to do. No office can require a change. Add the spouse's name to the passport if you wish, without changing your own.
Husband takes the wife's surname
Allowed. The same two paths apply; most offices will still want a gazette because the certificate alone does not signal the direction of the change.
After a Married Surname Change: Aadhaar, PAN, Bank and Passport Order
| Order | Office | Bring |
|---|---|---|
| 1 | Aadhaar (Seva Kendra) | Marriage certificate or gazette; current Aadhaar; two changes in a lifetime |
| 2 | PAN | Updated Aadhaar plus certificate or gazette; correction, not new PAN |
| 3 | Bank accounts, joint accounts, nominations | Aadhaar, PAN, certificate or gazette; fresh signature if changed |
| 4 | Passport (reissue) | Marriage certificate, spouse's details, or the Gazette of India page; new booklet and number |
| 5 | Voter ID, DL, RC | Form 8 free; RTO with the proof |
| 6 | Employer, EPFO, insurance, property | Same proof; nominations separately |
Mistakes in a Name Change After Marriage That Cost a Second Fee
Buying a gazette before trying the certificate
For a plain married surname most offices want the certificate. Try Path A first; it is free.
Updating the bank before Aadhaar
Every office reads Aadhaar. Change it first, or the bank asks you to come back.
Affidavit without the husband's name
The Kolkata Gazette Part II wants father's or husband's name and address on the affidavit; for a married woman, give both.
Filing a first name change as "surname on marriage"
If anything other than the surname changes, it is Change of Name, Annexure I, and the newspaper notice must say so.
Applying for a visa between passport reissue steps
Reissue gives a new passport number and old visas do not carry over. Finish the name change and reissue before any visa filing.
Changing Aadhaar twice
Two name changes in a lifetime. Decide the exact form of the new name once: with or without the maiden surname, hyphen or not.
Common Questions People Search About Surname Change After Marriage
Three short answers to the searches that bring people to this page.
How long after marriage can I change my surname in West Bengal?
There is no time limit. You can do it a month after the wedding or twenty years later, and nothing expires. What does age is the paperwork inside a Central Gazette file, where nothing may be older than one year on the day it reaches Delhi. The marriage certificate itself never expires.
Can I change my surname on Aadhaar with just the marriage certificate?
Usually yes, if the certificate is registered and shows both your previous name and your married name. The update is made in person at an Aadhaar Seva Kendra, not online. Remember that Aadhaar allows only two name changes in a lifetime, so settle the spelling first.
What if my marriage is not registered?
Then the certificate route is closed, because there is no certificate to produce. You have two options: register the marriage, which is worth doing anyway for property, insurance and visa purposes, or take the gazette route with an affidavit and two newspaper notices. Many families do both, in that order.

Marriage Name Change Terms Explained: Annexure II, Maiden Name, Reissue
Eight words you will meet while changing a surname after marriage, in one line each.
Maiden name
The surname you carried before marriage. It stays on your birth certificate and your board certificates, which record history and are not rewritten.
Registered marriage certificate
A certificate issued by a Registrar of Marriages, not a temple, church or banquet receipt. Only a registered certificate carries weight with Aadhaar, PAN and the passport office.
Annexure II
The undertaking on the Kolkata Gazette Part II portal for a change of surname, including adding a husband's surname, deleting one, or reverting to a maiden name.
Change of Surname
The category you select on the state portal when only the surname changes. If the first name changes as well it becomes a change of name, and a different annexure applies.
Hyphenated surname
Keeping both surnames joined, for example Sen-Roy. It is a full surname change like any other, so the certificate or gazette rule still applies.
Reissue
The passport word for a new booklet with a new number. A passport is never edited, so a married surname means a reissue, and existing visas do not carry over.
Service book
The employment record of a Government servant. A married surname is entered here on written intimation to the appointing authority, and that entry is what changes the record.
Supporting proof
What a gazette actually is. It rewrites no register by itself. You still apply to Aadhaar, PAN, the bank and every other office separately, carrying the gazette page.

The rule is the same across West Bengal. Only two steps are local: the affidavit before a Magistrate at a court in your subdivision, and the newspaper booking. Send your marriage certificate on WhatsApp from any district and we will tell you whether a gazette is needed at all.
Gazette Name Change After Marriage in West Bengal: Frequently Asked Questions
Is a gazette compulsory for a name change after marriage in West Bengal?
No. There is no legal duty to change your name on marriage, and where you do change only the surname, a registered marriage certificate showing both names is usually accepted by Aadhaar, PAN, banks and the passport office. A gazette is needed when the certificate does not carry both names, when an office insists, when you are changing more than the surname, or when a foreign office wants the Government's own record.
Which gazette should I use for a surname change after marriage in West Bengal?
Kolkata Gazette Part II if the new surname is for Aadhaar, PAN, bank and state records: online, Rs 1,100, within 7 days, filed under Annexure II. Gazette of India if a passport, visa or out-of-state use is involved: by post, Rs 1,100, 30 to 45 days. Both use the same affidavit and newspaper pages.
Can I add my husband's surname without a gazette?
Usually yes, with a registered marriage certificate that shows your name and his. Update Aadhaar first at a Seva Kendra with the certificate, then PAN, then the bank. If any office refuses, that is the point to file the gazette.
Can my husband take my surname, or can we both keep our own?
Yes to both. Either spouse may adopt the other's surname, or neither. The gazette route is the same for a man changing surname.
What documents are needed for a gazette surname change after marriage?
Registered marriage certificate, affidavit (Magistrate-attested for the state route, notarised for the central), newspaper pages in one Bengali and one English daily, Aadhaar or Passport, address proof, two photographs, fee receipt. The affidavit should give your father's name and your husband's name.
Does the Kolkata Gazette Part II guideline cover surname change on marriage?
Yes. The guideline expressly covers addition or change of surname on marriage or remarriage, including for State Government employees, under change of surname, Annexure II, at Rs 1,100.
How long does a gazette name change after marriage take in West Bengal?
Kolkata Gazette Part II: within 7 days of a complete file. Gazette of India: 30 to 45 days after the file reaches Delhi. The marriage certificate route needs no gazette time at all, only each office's own update time.
Should I change my name before or after my passport reissue?
Do the gazette first if the passport office will ask for it, then apply for reissue with the Gazette of India page and the marriage certificate. Reissue gives a new booklet and number, and existing visas do not carry over, so time it before any visa application.
What if my marriage is not registered?
Register it first. An unregistered marriage leaves you with only the gazette route, and even then offices may ask for proof of the marriage that led to the surname change. Registration is also what the passport office wants for a spouse's name.
Can I revert to my maiden name later?
Yes. The Kolkata Gazette Part II expressly covers reversion to maiden name on divorce, separation or death of husband, with the decree or death certificate attached, under change of surname at Rs 1,100. Name change after divorce in West Bengal.
Will Aadhaar accept the new surname on the marriage certificate alone?
In practice yes, at a Seva Kendra, provided the certificate shows both names and your address matches. Remember UIDAI allows only two name changes in a lifetime, so settle the exact form of the new name first.
Do both routes need a newspaper notice for a married surname?
The gazette routes do. The marriage certificate route does not. If you go through a gazette, publish in one Bengali and one English daily so the pages work for either gazette.
