Documents for Name Change After Divorce in West Bengal: The Gazette File, Then Office by Office
After marriage, one certificate carried your name through every office. After divorce, the decree cannot do that job: it proves the marriage ended, not the name you are going back to. So you build one gazette file, and the published gazette page becomes the master document for Aadhaar, PAN, bank, passport and the rest. This page lists both files, and what each office wants.

Which Documents Do You Need for a Name Change After Divorce in West Bengal? (Quick Answer)
For the gazette file: the certified divorce decree (or judicial separation order), an affidavit attested by a First Class Judicial Magistrate (notary for the Gazette of India) citing the decree and stating the reverted name, complete newspaper pages in one Bengali and one English daily, Aadhaar or passport, address proof for West Bengal domicile, photographs, and the fee receipt (Rs 1,100 on GRIPS or BharatKosh). Afterwards: the published gazette page, printed several times, plus your current IDs, is what Aadhaar, PAN, the bank, the voter roll and the passport office read; the passport office also takes the decree for deleting the spouse's name. The decree alone does not change a name at any of them.

Why Documents for Name Change After Divorce Differ From Those After Marriage
A marriage certificate shows both the maiden and the married name, so it doubles as proof of a surname change at Aadhaar, PAN, the bank and the passport office. A divorce decree shows that a marriage ended. It does not state the name you will now use, unless the court added a clause, and none of those offices work from decrees; they work from their document lists.
So after divorce there are two files. The gazette file, which you build once, with the decree as its supporting document. And the master file you carry afterwards: the published gazette page and your current IDs. Both are below.
Keeping the married name?
Then neither file is needed. Nothing changes on any document because of the divorce alone; only the passport's spouse-name field, if you want it deleted, on the decree. Your four options after divorce.
Certified Divorce Decree: The First Document for a Name Change After Divorce
- A certified copy from the court that passed it: family court or district court, with seal and date
- The final decree, not an interim order or a copy of the petition
- Your name spelt on it as on your current IDs
- Judicial separation order works the same way for the state gazette
- Two photocopies made before the original goes anywhere
Does it have a name clause?
Read it. A clause restoring your maiden name helps at some counters, but it does not replace the gazette; the passport office and most others want the gazette regardless. What the decree does and does not do.

Affidavit for Name Change After Divorce: What It Must Say
- Your name as currently held (the married name), daughter of your father with his name, your full address
- The marriage: to whom, when, where; and the decree by court, number and date
- The change: "have reverted to my maiden name [X]" or "have dropped the surname [Y] and shall be known as [Z]", spelt exactly as wanted
- That the married name and the new name are one and the same person
- Verification, signature in the married name, attestation with affidavit number
Copy from the affidavit
The newspaper text and the portal declaration are copied from the affidavit, never the other way round. The reversion wording is in the affidavit guide, variants table; the newspaper and gazette formats are in the format and sample guide.

Document Mistakes That Return a Name Change File After Divorce
Uncertified decree, or an interim order
The portal wants the certified final decree uploaded. Get it from the court first.
Affidavit without the father's name
The reversion links back to your birth identity; give the father's name and address.
Notary affidavit on the state route
The Part II portal wants a Magistrate's affidavit number.
Carrying the decree to Aadhaar or PAN as the name proof
They want the gazette page. Build the gazette file first.
Only the state gazette page for the passport
The passport office wants the Gazette of India for the name, and the decree for the spouse's name deletion.
Posting the only copy of the decree or newspaper pages
The central file does not come back. Photocopy first.
Documents for Name Change After Divorce in West Bengal: Frequently Asked Questions
What documents are needed for a name change after divorce in West Bengal?
For the gazette: the certified divorce decree or judicial separation order, an affidavit attested by a First Class Judicial Magistrate (notary for the Gazette of India), complete newspaper pages in one Bengali and one English daily, Aadhaar or passport, address proof for West Bengal domicile, photographs and the fee receipt. Then the published gazette page itself, printed several times, becomes the document every office reads, together with your current IDs.
Is the divorce decree the main document?
It is the supporting document, not the proof of the new name. The decree records that the marriage ended; the gazette records the reversion. Aadhaar, PAN, banks and the passport office want the gazette; the decree goes in as support, and for the passport it separately proves deletion of the spouse's name.
Which gazette page do I need: state or central?
The Kolkata Gazette Part II page for Aadhaar, PAN, bank, voter ID and state records. The Gazette of India page for the passport or use outside West Bengal. Both, if a passport is anywhere in your plans.
What must the affidavit contain after divorce?
Your married name as currently held; daughter of your father, with his name; your address; the marriage and the decree by number, date and court; the statement that you revert to your maiden name or drop the married surname, with the exact new name; that both names are one and the same person; and the verification. Signed in the married name.
Do I need the marriage certificate as well?
Not for the gazette. Keep a copy in the folder: the passport office sometimes asks for it alongside the decree when deleting the spouse's name, and it helps link the sequence of names if any office queries the history.
Does the decree need to be certified?
Yes. A certified copy from the court that passed it, with the seal. The state portal wants it uploaded; the central file wants a copy; an uncertified print or an interim order is a shortfall.
What if I am separated without a court order?
There is no order to attach. The affidavit alone carries the change, filed as an ordinary Change of Name, and offices may ask why. If a decree or separation order is close, wait for it and file under Annexure II.
Which documents does each office want after the gazette?
Aadhaar: gazette, current Aadhaar, address proof if moving. PAN: gazette and updated Aadhaar. Bank: KYC form, gazette, Aadhaar, PAN. Passport: decree for deletion of spouse's name, Gazette of India page, newspaper pages and affidavit for the name. Voter ID: Form 8 with the gazette or updated Aadhaar. Each office's own list is the final word.
Do documents come back after the gazette is published?
The Gazette of India file is not returned; the state portal keeps scans. Photocopy the decree, the affidavit and the newspaper pages before anything is posted or uploaded.
How many copies of the gazette should I keep?
Several printed copies of the notification page, plus the PDF on your phone. Aadhaar, PAN, bank, passport, voter ID, RTO, employer and property records each keep one.
Are documents different for taking a new name rather than the maiden name?
The same file, with two differences: the affidavit states the new name and the reason, and the state application is filed as Change of Name, Annexure I, with the decree as a supporting document.
What about my children's documents?
Separate. A child's name change needs the child's birth certificate, the custody order, the parent's ID and affidavit, and the Gazette of India with a parent as applicant. Nothing in your file changes the child's records.
