Bank Account Name Change After Divorce in West Bengal: The Name Is the Easy Part
Changing the name on an account is a short application. What people leave undone, sometimes for years, is the nominee, still recording a former spouse on every account and deposit. Add the joint account nobody closed and the standing instructions that carried on running, and the name turns out to be the least of it.

Bank Accounts After a Divorce (Quick Answer)
First, decide whether the name changes at all, since nothing requires you to revert. If it does, check what your decree says: where it records the restoration of your former name, banks commonly accept it, and where it is silent on the name, a gazette notification is what establishes it. Then Aadhaar, then PAN, then each bank separately, because banks work from KYC records. Your account number does not change and your standing instructions keep running. Then do the part that matters most: change the nominee on every account and deposit, using the bank's nomination form, normally free. Finally review any joint account, taking legal advice first where the decree deals with financial arrangements.

| Item | Affected by the name change? | What to do |
|---|---|---|
| Account holder name | Yes, this is the request | Bank's form, with the decree or gazette |
| Account number | No | Nothing; it stays the same |
| Nominee | No | Separate nomination form, every account and deposit |
| Joint account holder | No | Unaffected by your name change; closure is a separate question |
| Mode of operation | No | Unchanged unless you apply to change it |
| Standing instructions and SIPs | No, they keep running | Review them; some may need stopping for other reasons |
| Cards and cheque book | Not automatically | Request replacements in the new name |
| Deposits, loans, demat, insurance | No | Each needs its own request |

Reverting to Your Maiden Name After Divorce Is a Choice
Nothing in law requires you to change your name after a divorce, and no bank will ask you to. Plenty of people keep the married name, often because children carry that surname, or because a career and a professional reputation were built under it.
Equally, plenty revert, and some adopt a name that is neither. All three are ordinary. What matters is deciding once, and then making every record agree, because the difficulty comes from records disagreeing rather than from any particular choice.
If you are undecided
There is no deadline. Nothing expires and nothing gets harder for waiting a few months. Deal with the nominee now, which needs doing either way, and take the name decision when you are ready.
Divorce Decree or Gazette: What the Bank Accepts
A decree dissolves a marriage. That is what it is for. It does not automatically declare that you are now called something else, and this is where people are surprised at the counter.
Where the decree records the restoration of your former name, it is strong evidence and banks commonly accept it with your identity documents.
Where the decree is silent on the name, which is common, the bank has nothing saying what you are now called. That is what a gazette notification does, and it is why most cases still need one.
Read your decree before you plan anything
Look for any line dealing with your name. Five minutes with that document tells you whether you need a gazette at all, and stops you buying one you may not require.
Change the Bank Nominee After Divorce on Every Account and Deposit
This is the reason this page exists. A nomination made during a marriage stays exactly as it was until you change it. A divorce does not touch it, and neither does changing the name on the account.
So the former spouse remains the recorded nominee on the savings account, the fixed deposits, the recurring deposits and often the demat account too, sometimes for years, until something happens and it is discovered at the worst possible moment.
Changing it is a short nomination form at the branch, normally with no fee, and it has to be done for each account and each deposit separately. Ask the branch for a list of everything you hold there so nothing is missed.
Beyond the bank
The same question applies to insurance policies, mutual fund folios, provident fund records and any pension scheme. Each keeps its own nomination, and none of them updates because a marriage ended.
Joint Bank Accounts After Divorce: What to Be Careful About
On the name itself, joint accounts are simpler than people expect. Changing your own name needs only your documents; the other holder's name is unaffected and the mode of operation does not change. Some banks ask both holders to sign the paperwork, so check before you go.
Closing or restructuring a joint account is an entirely different question from changing a name on it, and it is not a documentation question at all. Where your decree deals with financial arrangements, take legal advice before moving money, closing an account or removing a holder.
Where our work stops
We prepare name change documentation. What happens to jointly held money is a matter between you, the other holder and your lawyers, and nobody should be advising you on it from a web page.
Standing Instructions and Auto Debits Continue After Divorce
Auto-debit mandates, systematic investment plans, insurance premiums and bill payments are tied to the account, not to your name, so a name change does not interrupt any of them. That is good news for the ones you want, and precisely why the others get forgotten.
Sit down once with a statement and read every recurring debit. Some will be for things that are no longer yours to pay, or that pay into arrangements that have ended. Stopping them is a separate instruction to the bank, and nothing about the name change does it for you.
Also worth checking
Which mobile number and email the bank has, and where statements and alerts are being sent. These are quick to change and easy to overlook.

Update Every Bank Account, Including Old Ones
Each bank holds its own records and each needs its own request, with the same documents. Before you start, write down every account you hold anywhere, and include:
- The old salary account from a previous employer
- An account opened only to service a loan
- A joint account with a parent or sibling
- Deposits held at a bank you otherwise stopped using
- Any account where the nominee was set years ago and never revisited
The forgotten account
It is always the one that matters later, usually at a maturity or a claim. An hour spent listing them now is the cheapest part of this whole exercise.
Bank Accounts After Divorce: Frequently Asked Questions
Do I have to change my name after a divorce?
No. Keeping the married name is an ordinary choice and many people make it, particularly where children carry that surname or a career was built under it. Nothing in the law requires you to revert, and a bank will not ask you to.
Is the divorce decree enough for the bank?
Sometimes, and it depends what the decree says. A decree dissolves the marriage; it does not automatically declare that you are now called something else. Where the decree records the restoration of your former name, banks commonly accept it. Where it is silent on the name, most will want a gazette notification, because that is the document that establishes the name.
What is the single most important thing to check?
The nominee. If your former spouse is still recorded as the nominee on your accounts and deposits, changing the name on the account does nothing about it. This is the part people leave for years and the part that causes real difficulty later.
How do I change the nominee?
With the bank's nomination form, at the branch, for each account and each deposit separately. It is a short form and there is normally no fee. Who you nominate instead is entirely your decision, and worth thinking about rather than filling in quickly.
What about a joint account with my former spouse?
Changing your own name on a joint account requires only your documents, and the other holder's name and the mode of operation are unaffected. Closing or restructuring the account is a different question, and where a decree deals with financial arrangements you should take legal advice before moving money or closing anything.
Will my standing instructions and SIPs stop?
No. Auto-debit mandates, systematic investment plans and bill payments continue running through a name change; they are tied to the account rather than the name. Check them anyway, because a divorce often means some of them should be stopped or redirected for reasons that have nothing to do with the name.
Does my account number change?
No. The account number belongs to the account. Only the recorded name is updated, and everything linked to it continues on the same number.
What order should I work in?
Gazette or decree first, then Aadhaar, then PAN, then the banks, because banks work from KYC records and will check them. Then the nominee, the cards and the linked products.
Which gazette do I need?
For an adult resident of West Bengal with no passport involved, the Kolkata Gazette Part II, published in about a week for Rs 1,100. The Gazette of India where a passport is also changing or you live outside the state, taking about 30 to 45 days.
Should the newspaper notice mention the divorce?
No. A change of name notice states the old name, the new name and your particulars. It does not have to explain why, and there is no reason to put a divorce into a public advertisement.
What about accounts I opened in my married name years ago?
Each bank holds its own records and each needs its own request, with the same set of documents. Make a list first, including the account nobody uses, because those are the ones that surface at the least convenient moment.
Do you handle this?
We prepare the gazette notification and the documentation around it. The bank applications and the nomination forms are short and you make them yourself. Anything about the decree, financial arrangements or property is a matter for your lawyer, not for us.
