Surname Change for a Child in West Bengal: A Parent's Guide to the Gazette Route
A child's surname cannot go through the state gazette; the Kolkata Gazette Part II is for applicants aged 18 and above. It goes through the Gazette of India, filed by a parent, at the minor fee. What decides whether the file sails through or gets questioned years later is the reason: adoption, divorce, remarriage or a simple alignment, and the order or consent each one needs. This guide covers that, the file, and why the school record comes before Aadhaar.

How to Change a Child's Surname in West Bengal (Quick Answer)
Through the Gazette of India, Part IV, with a parent or legal guardian as applicant. Get the document the reason needs (adoption order, custody order, or both parents' agreement), then a notarised affidavit by the parent declaring the child's old and new name and date of birth, a notice in one Bengali and one English daily, the typed proforma with two witnesses, the child's birth certificate, the parent's ID, two photographs of the child, and Rs 1,700 on BharatKosh, posted in the parent's name to Civil Lines, Delhi-110054. Publication in 30 to 45 days; download from egazette.gov.in. Then update the school record first, then Aadhaar, passport and any existing board marksheet. Why a Child's Surname Change Cannot Go Through the Kolkata Gazette Part II
The state portal registers an adult with their own mobile and a declaration sworn in their own name before a Magistrate. It accepts applicants aged 18 and above and has no field for a guardian acting for a child. The Gazette of India route has always allowed a parent or legal guardian to apply for a minor, at a separate fee, with the child's birth certificate in the file. For anyone under 18 in West Bengal, that is the only route.
The upside
A Gazette of India notification is valid across India and abroad, so the same page serves the school, Aadhaar, the passport, a board outside the state and any overseas study later. Gazette name change for a minor: the full parent's guide.
Child Surname Change by Reason: The Order or Consent Each One Needs
| Reason | Attach | Who signs | Risk if missing |
|---|---|---|---|
| Adoption: child takes the adoptive parents' surname | Adoption order or registered adoption deed | Adoptive parents | Low; the order settles authority |
| Divorce: child takes the custodial parent's surname | Custody order or decree; consent of the other parent where they retain rights, or a court order | Custodial parent, plus the other parent's consent | High; school, passport and board can question it years later |
| Remarriage: child takes the step-parent's surname | Custody order; step-parent adoption order where one exists; biological parent's consent otherwise | Both, or the adoption order | High without an adoption order or consent |
| Alignment: child's surname made to match a parent's changed surname | Parent's gazette notification; birth certificate | Both parents | Low if both sign |
| Surname spelt differently on birth certificate and school record | Often a Registrar correction, not a gazette | Parents | Check first; see the birth certificate section |
| Community or family surname added | Parents' affidavit stating the reason | Both parents | Low if both sign |
Name change after divorce: the parent's own name, separately.
Do Both Parents Need to Sign a Child's Surname Change?
The Department of Publication's checklist asks for a parent or guardian as applicant; it does not require both. Nobody asks at filing. Somebody asks later: a school admission officer, a passport counter, a board correction cell, when the other parent's absence from the file has to be explained and that parent is hard to reach. Where both parents have rights, both signing the affidavit and the proforma closes the question for good.
- Both parents alive and married: both sign
- Divorced, joint or shared rights: custodial parent signs, other parent's written consent attached, or a court order
- Sole custody, other parent's rights ended by court: the order alone
- Widowed: death certificate of the other parent
- Guardian, not a parent: guardianship order
- Parents disagree: a court order is needed before the gazette file will hold
How to Change a Child's Surname in West Bengal: 7 Steps
Get the order the reason needs
Adoption, custody or guardianship order, certified copy; or the other parent's written consent. For a simple alignment, both parents' agreement is enough.
Parent's affidavit
Notarised: "I, [parent], father/mother of [child's old name], born on [date], residing at [address], declare that my child's surname is changed from [old] to [new] for the reason that [reason]." Both parents sign where both have rights. Not older than one year when the file reaches Delhi.
Notice in two newspapers
One Bengali and one English daily, in the parent's name on behalf of the child, showing the child's old and new name, the parent's name and the address. Keep the complete pages.
Proforma, soft copy, certificate
Downloaded from deptpub.gov.in, computer typed with the parent as applicant, the child's names exactly as in the affidavit and newspapers, two witnesses; soft copy file and a certificate that hard and soft copies match.
Rs 1,700 on BharatKosh, post to Delhi
Affidavit, both newspaper pages, proforma, soft copy, certificate, child's birth certificate, the order or consent, parent's self-attested ID, two photographs of the child, and the receipt, by speed post to Department of Publication, Civil Lines, Delhi-110054, in the parent's name. Agents cannot submit. Keep the tracking slip.

After a Child's Surname Change: School, Aadhaar, Passport and Board
School record
Give the school the gazette page and newspaper pages first. The admission register and the name that will go to the board flow from here.
Aadhaar
Seva Kendra with the gazette, birth certificate and the parent's ID. Two name changes in a lifetime apply to the child too; decide the final form once.
Passport
Fresh passport or reissue in the new name with the Gazette of India page, newspaper pages and both parents' documents as Passport Seva lists.
Board, before the window closes
If a marksheet already exists, apply to WBBSE, WBCHSE, CBSE or ICSE for correction or endorsement with the gazette. Correction windows close within a few years of results.
Does the Birth Certificate Change After a Child's Surname Change?
The gazette records the new name; it does not alter the birth certificate. Whether the certificate should change depends on the case. After an adoption, the Registration of Births and Deaths Act provides for the adoptive parents' particulars to be entered on the order; ask the Registrar that issued the certificate. A spelling error is a Registrar correction under Section 15, not a gazette matter at all. For a plain surname change after divorce or remarriage, most families leave the birth certificate as the record of birth and rely on the gazette to link the names.
Check before you file
If the only problem is a mismatch between the birth certificate and the school record, fix the wrong one at its source. A gazette does not repair a certificate. Correction or change: the decision table.
Mistakes in a Child's Surname Change That Resurface Years Later
Filing on the state portal in the parent's name
The portal is 18 and above; typing the child's names into an adult declaration is a misdeclaration and forfeits the fee.
One parent signing when the other retains rights
Nobody asks at filing. The passport counter or the board asks years later.
Step-parent's surname without an adoption order or consent
The file the passport office questions most. Get the order or the consent first.
Paying the adult fee
Rs 1,700 for a minor. A short-paid file is returned; the fee is not refunded.
Gazette first, school never
The board prints the school's name. Update the school the week the gazette arrives.
Using the gazette to fix a birth certificate typo
The Registrar corrects it. Two documents that still disagree is the result otherwise.
Surname Change for a Child in West Bengal: Frequently Asked Questions
How do I change my child's surname in West Bengal?
Through the Gazette of India, Part IV, with a parent or legal guardian as applicant: a notarised affidavit by the parent, notice in one Bengali and one English daily, the typed proforma with two witnesses, the child's birth certificate, the parent's ID, the adoption or custody order where the reason needs one, two photographs of the child, and Rs 1,700 on BharatKosh, posted to the Department of Publication in Delhi. Publication in 30 to 45 days. Then the school record, Aadhaar and passport.
Can a child's surname be changed through the Kolkata Gazette Part II?
No. The state portal accepts applicants aged 18 and above; there is no guardian field. Every surname change for a minor in West Bengal goes through the Gazette of India.
What is the fee for a child's surname change?
Rs 1,700 on bharatkosh.gov.in for the Gazette of India minor category, non-refundable. Affidavit, newspaper notices and speed post are extra and small.
Do both parents have to sign for a child's surname change?
The Department's checklist asks for the parent or guardian as applicant. In practice, where both parents have rights, both should sign the affidavit and the proforma; a school, passport office or board can later ask why the other parent did not consent, and both signatures close that question. A single parent or guardian attaches the custody, adoption or guardianship order that shows authority.
Can I change my child's surname to my new husband's after remarriage?
Yes, by the same central route, but the file should show authority: the custody order, and the consent of the biological father where he retains rights, or a court order. Files without this are the ones questioned years later at passport and board stage. A step-parent adoption order makes it clean.
Can I change my child's surname to mine after divorce?
Yes, with the custody order attached and, where the other parent retains rights, that parent's consent or a court order. The gazette records the new full name; the birth certificate is a separate matter through the Registrar.
What documents are needed for a child's surname change?
Child's birth certificate; parent's or guardian's Aadhaar or Passport; parent's notarised affidavit; two newspaper pages; typed proforma signed by the parent with two witnesses; soft copy and certificate; two photographs of the child; BharatKosh receipt for Rs 1,700; school ID if available; adoption, custody or guardianship order where relevant.
How long does a child's surname change take?
30 to 45 days after the file reaches Delhi, published in Part IV on a Saturday. There is no fast-track. Allow six to eight weeks before a school admission or passport deadline.
Does the gazette change the child's birth certificate?
No. The gazette records the new name; the birth certificate is corrected separately by the Registrar under the Registration of Births and Deaths Act where the Act allows, for example after adoption. For a plain surname change, most families update the school record and leave the birth certificate as the record of birth, read with the gazette.
What should be updated first after the child's gazette?
The school record, so the name that goes to the board is the new one. Then Aadhaar at a Seva Kendra with the gazette and birth certificate, then the passport, then the board if a marksheet already exists.
Can the child change the surname back as an adult?
Yes. Once 18, the child can apply in their own name on either gazette. The earlier notification remains a valid record of the earlier change.
Is a surname change for a child different from a name change for a minor?
Same route and fee. The difference is the reason and its document: a surname change after adoption, divorce or remarriage needs the order that shows the parent's authority, and usually both parents' signatures; a first-name change chosen by both parents needs only their affidavit.
What if the two parents disagree about the child's surname?
Then it is a contested case, and a court order is what settles it. Filing on one parent's affidavit while the other objects produces a notification that can be challenged later at school, passport or board stage. Get the order first.
Must a child carry the father's surname?
No. No law requires it. A child can carry the mother's surname, both surnames hyphenated or combined, or a chosen family surname. The parents decide, and the gazette records whatever full name is filed.
