Surname Change After Adoption in West Bengal: The Order Settles Authority, the Gazette Records the Name
Adoption is the one surname case where the paperwork is usually clean: the adoption order or registered deed already proves who may decide the child's name. What remains is recording the new name so schools, Aadhaar, the passport office and boards all read the same thing. This guide covers the child path, the adult adoptee path, and the birth certificate question that is not a gazette matter at all.

How to Change a Surname After Adoption in West Bengal (Quick Answer)
Start with the certified adoption order or registered adoption deed, whichever your adoption route produced. For a child: file through the Gazette of India with an adoptive parent as applicant, at Rs 1,700 on BharatKosh, with the parent's notarised affidavit, two newspaper notices, the proforma with two witnesses, the child's birth certificate, the adoption document and the parents' ID, posted to Delhi; published in 30 to 45 days. For an adult adoptee: the Kolkata Gazette Part II under Change of Surname, Annexure II, online, Rs 1,100, within 7 days of a complete file. Afterwards update the school record first, then Aadhaar, the passport and any board record. The birth certificate is separate: ask the court and the Registrar.

Adoption Order or Adoption Deed: Which Document Supports the Surname Change
Changing the name is not compulsory after adoption; many families do it for consistency across school, Aadhaar and passport records.
Adoptions in India follow different routes, and each ends in a different piece of paper. An adoption through the statutory process under the Juvenile Justice Act, 2015 ends in a court adoption order. An adoption under the Hindu Adoptions and Maintenance Act, 1956 within a family is usually evidenced by a registered adoption deed, and may also have a court order. Either works for the gazette; take a certified copy of whichever you hold.
What does not work is an informal family arrangement with no order and no registered deed. In that case the child's name can still be changed by the parents on record, but the file is a plain name change with the birth parents' authority, not an adoption case, and a school or passport office may ask questions the paperwork cannot answer. Speak to a lawyer about regularising the adoption first.
We do not advise on the adoption itself
Which adoption route applies, and what your order allows, are questions for the court and your lawyer. We handle what comes after: the affidavit, the newspaper, the gazette, and the record updates.
Choosing the Adopted Child's New Name and Surname Before You File
Surname only
The given name stays; the adoptive parents' surname replaces the old one. The most common choice for an older child, and the least disruptive at school.
Given name and surname
Both change, filed as one change of name in the same application. Common for a very young child.
Keep both surnames
Some families keep the birth surname as a middle name, or use both surnames hyphenated. No law requires a child to carry the father's surname; the choice is the parents'. Write the exact form; the gazette prints what you type.
The lifetime limit
Aadhaar allows two name changes in a lifetime, for a child too. Decide the final form once, before the Kendra visit.

Birth Certificate After Adoption in West Bengal: A Registrar Question, Not a Gazette One
Families often assume the gazette will produce a birth certificate with the adoptive parents' names. It does not. The gazette records a change of name; the birth register is maintained under the Registration of Births and Deaths Act, and what can be entered after an adoption depends on the adoption order and the registering authority. Some adoptive parents obtain a fresh certificate on the strength of the order; others hold the original certificate alongside the adoption order and the gazette, which together tell the whole story to any office.
Ask two people, in this order: the court that passed the order, and the Registrar (KMC, municipality or panchayat) that issued the certificate. Do that before you assume either outcome.
What we can say
Whatever happens with the certificate, the gazette is worth having: it is the document that links the old name and the new one for school, Aadhaar, passport and boards. How the Registrar correction route works.
After the Adoption Name Change: School, Aadhaar and Passport Updates
School record
Gazette page and newspaper pages to the school. The board takes the name from the admission register, so this comes before everything else.
Aadhaar
Seva Kendra with the gazette, adoption document and birth certificate; parents' details updated where recorded. Two name changes in a lifetime.
Passport
Fresh passport or reissue with the Gazette of India page, adoption document and both parents' documents as the Document Advisor lists for a minor.
Board, bank account, insurance nominations
Any existing marksheet through the board's correction or endorsement route; minor accounts and policies with the gazette.
Adoption Privacy: What the Newspaper Notice and Gazette Show
Both gazettes are public records, and the newspaper notice is public by design. The notice and the notification carry the old name, the new name, the parent's name and the address. They do not have to state that the change follows an adoption; the affidavit carries the reason for the office, while the published notice can read simply as a change of name. Families who prefer discretion should ask for the wording to be drafted that way from the start.
Ask us for the neutral wording
We draft the affidavit with the adoption cited for the office, and the newspaper text in plain change-of-name form. Same file, less on the public page. Formats and samples.
Mistakes That Delay a Surname Change After Adoption
Filing a child's case on the state portal
Applicants 18 and above only. Minors go through the Gazette of India with a parent.
Expecting the gazette to reissue the birth certificate
Different office, different law. Ask the court and the Registrar.
Only one adoptive parent signing
Where both have rights, both should sign; the question surfaces at passport or board stage.
Uncertified copy of the order or deed
A certified copy goes into the file; a plain photocopy is a shortfall.
Changing the name twice
A given name changed now and adjusted later uses both Aadhaar changes. Settle it once.
Gazette done, school never told
The board prints the school's name. Tell the school the week the gazette arrives.
Surname Change After Adoption in West Bengal: Frequently Asked Questions
How do I change my adopted child's surname in West Bengal?
With the adoption order or registered adoption deed in hand, file through the Gazette of India with a parent as applicant: adoptive parent's notarised affidavit, two newspaper notices, the typed proforma with two witnesses, the child's birth certificate, the adoption document, the parents' ID, two photographs and Rs 1,700 on BharatKosh, posted to Delhi. Published in 30 to 45 days. Then the school record, Aadhaar and the passport. The state gazette cannot be used for anyone under 18.
Which document proves the adoption for the gazette?
Whatever your adoption route produced: a court adoption order where the adoption went through the statutory process, or a registered adoption deed where the adoption was made under personal law. A certified copy goes into the gazette file. An unregistered family arrangement is not an adoption document and will not carry the change.
Does the gazette change the child's birth certificate after adoption?
No. The gazette records the name. A post-adoption birth certificate is a separate matter with the Registrar of Births and Deaths, on the strength of the adoption order, and what is possible depends on the order and the registering authority. Ask the court that passed the order and the Registrar that issued the certificate before you assume either way.
Can an adult adoptee change their surname?
Yes, and it is simpler: an adult applies in their own name. In West Bengal, the Kolkata Gazette Part II under Change of Surname, Annexure II, with the adoption document attached, Rs 1,100, within 7 days of a complete file. The Gazette of India instead if a passport is involved or you live outside the state.
Do both adoptive parents have to sign?
For a child, yes in practice. Both adoptive parents signing the affidavit and the proforma closes the question a school, passport office or board can raise years later. A single adoptive parent attaches the order that shows sole authority.
What is the fee for a surname change after adoption?
Rs 1,700 on BharatKosh for a child through the Gazette of India; Rs 1,100 for an adult adoptee on either gazette. Affidavit, newspapers and courier are extra and small.
Can the child's first name be changed at the same time?
Yes. Many adoptive families change the given name and the surname together; it is filed as one change of name in the same gazette application, with both the old and new full name in the affidavit and the newspaper notice.
How long does it take?
30 to 45 days after the file reaches Delhi for a child; about a week for an adult on the state gazette, or the same 30 to 45 days centrally. Allow six to eight weeks before a school admission or passport deadline.
What should be updated first after the adoption gazette?
The school record, because the board takes the name from it. Then Aadhaar at a Seva Kendra with the gazette, adoption document and birth certificate, then the passport, then any existing marksheet.
Does an adopted child need a new Aadhaar?
No. The existing Aadhaar is updated with the new name, and the parents' details are updated where they are recorded. Aadhaar allows two name changes in a lifetime, so settle the final form of the name before the Kendra visit.
What about the child's passport after adoption?
A fresh passport or reissue in the new name with the Gazette of India page, the adoption document and both adoptive parents' documents as Passport Seva's Document Advisor lists for a minor.
Can we keep the child's original given name and change only the surname?
Yes. That is a surname change, and the affidavit and newspaper notice say exactly that. Many families keep the given name deliberately; nothing in the gazette process pushes you either way.
Is it compulsory to change an adopted child's name?
No. Nothing in law requires it. Most adoptive families do it so that the school record, Aadhaar, passport and board documents all read the same, but keeping the child's existing name is equally valid.
Can the child carry both surnames after adoption?
Yes. No law requires a child to carry the father's surname, and parents may use both surnames, hyphenated or combined, or keep the birth surname as a middle name. Write the exact form you want; the gazette prints what you type.
Which law does my adoption order come under?
Statutory adoptions go through the Juvenile Justice Act, 2015 process and end in a court adoption order. Adoptions within a family under the Hindu Adoptions and Maintenance Act, 1956 are usually evidenced by a registered adoption deed. Either document supports the gazette file; which route applies to your adoption is a question for the court and your lawyer.
