Birth Certificate After Adoption in West Bengal: A New Certificate, Not a Correction

Adoption does not amend an existing entry. A fresh birth certificate is issued, naming the adoptive parents as parents and carrying the date of birth as recorded in the adoption order. And for an adoption through an agency, obtaining it is largely the agency's duty, not something families should be chasing alone.

The Birth Certificate After an Adoption (Quick Answer)

A new birth certificate is issued, showing the adoptive parents as parents and the date of birth as recorded in the adoption order. The old entry is not corrected, because nothing about it was wrong. Under the Adoption Regulations, a Specialised Adoption Agency is to approach the birth certificate issuing authority within five days of obtaining the certified copy of the adoption order, so in an agency adoption this is the agency's responsibility. Since the Juvenile Justice Amendment Act of 2021 came into force in September 2022, the adoption order is passed by the District Magistrate, with an appeal to the Divisional Commissioner within thirty days. Adoptions under the Hindu Adoptions and Maintenance Act, 1956 follow their own route, and guidance has required both the adoption deed and the order. A gazette is usually not needed for the certificate itself.

The Mechanism

New Birth Certificate After Adoption: The Agency Obtains It

Every other page on this site deals with records that were recorded wrongly. This one does not. The original entry was accurate for the facts as they stood; what changed afterwards is the child's legal parentage, and the law answers that with a fresh certificate rather than an amendment.

The new certificate names the adoptive parents as parents and carries the date of birth as recorded in the adoption order. And the Adoption Regulations put the duty in a specific place: the Specialised Adoption Agency shall approach the birth certificate issuing authority for it, within five days of obtaining the certified copy of the adoption order.

Ask your agency, first

Before you queue at a municipal office, ask the agency whether it has already applied and what stage it has reached. Families sometimes spend weeks pursuing a certificate that was already in process.

The Foundation

Adoption Order: Who Passes It Now Under the JJ Act

Everything rests on the adoption order. Since the Juvenile Justice Amendment Act of 2021 came into force in September 2022, that order is passed by the District Magistrate rather than by a civil court, on an application filed by the Specialised Adoption Agency in the district where it is located. A person aggrieved by the order may appeal to the Divisional Commissioner within thirty days.

Older guidance still describes court proceedings, so anything written before that change reads differently from current practice. Ask your agency or your lawyer what applies to your file rather than relying on an older article.

Keep certified copies

Get more than one certified copy of the order when it issues. It is the document every subsequent step reads, and obtaining further copies later is slower than asking at the time.

The Other Route

Adoption Under HAMA 1956 and Adoption Within the Family

The Hindu Adoptions and Maintenance Act, 1956 remains available to Hindus, and it is the common route for relative adoptions and step-parent adoptions within a family, which are also recognised under the juvenile justice framework.

One practical point for the birth certificate: guidance issued to registration authorities has required both the adoption deed and the adoption order for registering the birth of an adopted child, and this has been applied to non-institutional adoptions as well as agency ones. So keep both documents, and expect an office to ask for both even where you think one should suffice.

Surname is a separate question

What the child is called, and whether a surname changes at all, is not settled by the birth certificate mechanism. Surname change after adoption in West Bengal covers that side, including the point that nothing compels a change.

Important Warning

Why a Private Arrangement Is Not a Legal Adoption

Adoptions of unrelated children are channelled through the CARA system, and adoptions arranged outside it have been described as having no legal sanctity and as capable of amounting to an offence. Relative and step-parent adoptions have their own recognised routes; an informal handover between families is not one of them.

This matters for the birth certificate too, because there is no lawful way to obtain a certificate naming people as parents where no valid adoption exists. If anyone offers to arrange either the adoption or the certificate outside the system, that is the point to stop and take legal advice.

Where we stand

We do not advise on adoption and we do not prepare documents for it. This page exists so families understand which document does what; the adoption itself belongs with your agency, the authorities and a lawyer.

The Name

Adopted Child's Name on the New Birth Certificate

The new certificate records the name as the adoption order does. Beyond that, families make their own choices: many children take the adoptive family's surname, some keep the name they arrived with, and some carry both. Nothing compels any of these.

What does matter is consistency afterwards. Whatever is decided should be the name used on the certificate, on Aadhaar, at school, and everywhere else, because the difficulties children face later come from records disagreeing with one another rather than from any particular choice of name.

Decide once, early

Before the certificate is issued if possible, since changing a name afterwards means a fresh round of applications at every office.

Rarely Needed

Is a Gazette Needed After Adoption?

Not needed for the birth certificate itself. The new certificate follows the adoption order, which is a judicial or magisterial act, and no published declaration is required to support it.

Possibly needed where you want the child known by a name that goes beyond what the adoption order records, or where a school, board or passport office later asks for published proof linking an earlier name to the present one. For a child that means the Gazette of India, since the state gazette is open only to applicants aged 18 and above.

Ask before you buy

If an agent tells you a gazette is compulsory after adoption, ask which authority requires it and for what document. Usually the honest answer is that the adoption order already does the work.

Afterwards

Updating Aadhaar, School Records and Passport After Adoption

1

Aadhaar

Built from the birth certificate for a child, so it comes first. A child's Aadhaar.

2

School records

The admission register reads the birth certificate. The school half of the job, and boards have their own provisions for adoption cases.

3

Passport, where travel is involved

A minor's passport has its own consent rules, and inter-country cases run through their own approvals.

4

Everything else, from the certificate

Bank accounts, insurance and the rest read the certificate. Supply that rather than the adoption papers wherever an office will accept it.

Handled Sensibly

Adoption Privacy: What You Need to Disclose

The new certificate is your child's ordinary birth certificate. It is not accompanied by an explanation, and there is rarely a reason to hand anyone the adoption order alongside it.

Keep the order and the deed safely, produce them where an authority genuinely requires them, and let the certificate stand on its own everywhere else. Where an institution already holds the earlier certificate, supply the new one and ask for the file to be updated rather than leaving both in circulation.

What the child is told

That is a family matter and not a documentation one, and nothing on this page is intended to bear on it. What paperwork can do is make sure the records agree with each other, so that a form never asks a question a child was not ready for.

FAQ & People Also Ask

Birth Certificate After Adoption: Frequently Asked Questions

Is the old birth certificate corrected after adoption?

No, and this is the point most guides get wrong. Adoption does not correct an existing entry. A fresh birth certificate is issued, naming the adoptive parents as parents and carrying the date of birth as recorded in the adoption order. It is a new certificate rather than an amended one.

Who applies for it?

In an adoption through a Specialised Adoption Agency, the agency does. The Adoption Regulations require the agency to approach the birth certificate issuing authority for the child's certificate, with the adoptive parents as parents, within five days of obtaining the certified copy of the adoption order. Ask your agency about it rather than assuming it falls to you.

Who passes the adoption order now?

Since the Juvenile Justice Amendment Act of 2021 came into force in September 2022, the adoption order is passed by the District Magistrate rather than a civil court. A person aggrieved by the order may appeal to the Divisional Commissioner within thirty days.

What if we adopted under Hindu law rather than through CARA?

Adoption under the Hindu Adoptions and Maintenance Act, 1956 remains available to Hindus, and is the common route for relative and step-parent adoptions within a family. Guidance has required both the adoption deed and the adoption order for registering the birth of an adopted child, including in non-institutional adoptions, so keep both and expect to produce both.

Can we adopt privately without going through CARA?

Not an unrelated child. Adoptions of unrelated children outside the CARA system have been described as having no legal sanctity and as capable of amounting to an offence. Relative and step-parent adoptions follow their own recognised routes. If anyone offers to arrange an adoption outside the system, walk away and take legal advice.

Do we need a gazette notification for the child's new name?

Usually not for the birth certificate itself, because the new certificate follows the adoption order rather than a published declaration. A gazette becomes relevant where you are changing the child's name beyond what the adoption order records, or where a later institution asks for published proof.

Does the child have to take the adoptive family's surname?

Nothing compels it. Many families do, and some keep an existing name or use both. The adoption order and the certificate that follows it record what was decided; the choice is yours rather than a legal requirement.

How do we handle privacy?

Sensibly and without over-explaining. The new certificate is the child's ordinary birth certificate, and there is rarely a reason to hand anyone the adoption papers alongside it. Keep the order and the deed safely, produce them where an authority genuinely requires them, and let the certificate speak for itself elsewhere.

What about a child adopted from abroad, or taken abroad?

Inter-country adoption runs through CARA as the Central Authority under the Hague Convention, with additional approvals involved. Passport and visa steps follow their own rules and timelines, so raise them with your agency early rather than after the order.

Which records come next?

Aadhaar, then school records, then everything downstream, each supported by the new birth certificate rather than by the adoption papers where possible. Do them in order so each office reads a consistent set.

The old certificate is still in circulation. Does that matter?

It should not be produced going forward. Use the new certificate. If an institution already holds the earlier one, supply the new certificate and ask them to replace it on file.

Do you handle adoption matters?

No. Adoption is a legal process with its own authorities, and we do not advise on it or file for it. What we prepare is gazette documentation where a name change beyond the adoption order is genuinely needed, and we will tell you honestly when it is not.
