Succession Certificate Name Mismatch in West Bengal
When a family member dies in West Bengal without a nominee, a bank or company may ask the heirs for a succession certificate from a civil court. The court lists the deceased's debts and securities and names who may collect them. If the deceased's name in the bank, the post office and the share folio are all spelt differently, or an heir's Aadhaar does not match the petition, the certificate may not cover what you need. This page shows how to get the names into the petition right.

Succession Certificate Name Mismatch (Quick Answer)
A succession certificate is granted by a civil court in West Bengal for the deceased's debts and securities, such as bank deposits and shares, not land. In the petition, list the deceased's name in every form used across accounts, name every heir as on Aadhaar, and back the gaps with a one and the same person affidavit. For land, heirs usually need a warish (legal heir) certificate from the BL&LRO or Gram Panchayat instead.

| Problem | Fix |
|---|---|
| Deceased spelt differently in each account | List every version in the petition |
| Heir's Aadhaar differs from relationship proof | Affidavit plus supporting papers |
| An account was left out of the schedule | Ask the court to extend the certificate |
| Bank rejects certificate over a name | Show the petition's aka list and affidavit |
| Need it for land | Warish certificate, not this |
What a Succession Certificate Covers in West Bengal
A succession certificate is granted under Part X of the Indian Succession Act, 1925 by a civil court. It lets the named heir collect the deceased's debts and securities: bank deposits, fixed deposits, shares, bonds and similar money owed to the deceased.
Lawyers answering public questions on Kolkata cases stress that it is mainly for movable assets, not for land or a house.
Banks, companies and post offices ask for it when there is no nominee, or when the amount or a dispute makes them cautious.
The certificate lists the specific debts and securities in its schedule. Anything not listed is not covered.
Warish Certificate for Land, Not a Succession Certificate
For land records, West Bengal heirs usually need a warish (legal heir) certificate, which a land guide says is issued by the BL&LRO or Gram Panchayat and applied for through Banglarbhumi citizen services, with the death certificate, heirs' Aadhaar, relationship proof, khatian number and an affidavit listing all heirs.
The same guide says that when names differ across these papers, you get a one-line correction from the issuing office and upload again.
After that comes mutation; see mutation and name correction on Banglarbhumi.
Deceased's Name Spelt Differently: List Every Form in the Succession Petition
Older accounts in West Bengal often carry different spellings: "Sk. Abdul Rahman" at the post office, "Shaikh Abdur Rahaman" in a share folio. The example names are made up.
In the petition, give the name as on the death certificate and add "also known as" for every other version, account by account. Attach a statement or passbook copy for each.
A sworn affidavit by an heir that all these names are the same person helps; see one and the same person affidavit. For Muslim name spellings, see Md, Mohd, Sk and Sheikh spellings.
Legal Heir Names in the Succession Certificate Petition: Match Aadhaar
Section 372 requires the petition to give the family and near relatives of the deceased. Courts have treated full disclosure of near relatives as essential, so leaving out an heir can sink the petition.
Name each heir as on current Aadhaar, with relationship. A married daughter's current surname should be linked to her maiden name with her marriage certificate.
Heirs who do not want to claim usually give a no objection affidavit in their current names. For heirs giving up land shares, see release deed name mismatch.
Succession Certificate Court, Fee and Time in West Bengal: What Lawyers Say
Lawyers answering a public Kolkata question say the petition goes to the civil court where the deceased lived or had property, naming Alipore, Baruipur and Sealdah courts as Kolkata options.
The same answers estimate the court fee at around 3% of the amount, with very different figures for the upper limit, and the time at roughly six months to a year if no one objects, longer if contested. These are lawyers' estimates, not official rates.
The court usually issues notice to interested people and may order a newspaper publication inviting objections.
Bank Account or Shares Left Out of the Succession Certificate
If a bank account or folio is found after the certificate is granted, the Act allows the holder to apply to the same court to extend the certificate to that debt or security.
This is also the fix when an account was listed under a spelling the bank does not recognise. Give the bank's spelling in the extension petition.
For shares and demat, see shares transmission for heirs.
Nominee vs Legal Heir: When a Succession Certificate Is Needed
Where a valid nominee exists, banks and companies usually pay the nominee without a succession certificate. The nominee then holds the money for the legal heirs as the law requires.
Where the nominee's name in the account differs from the nominee's current ID, the nominee links the two by affidavit and ID, not by a succession certificate.
