Shares Transmission Name Mismatch for Heirs in West Bengal
When a shareholder dies, the shares pass to the nominee or legal heirs by transmission. The company's registrar, or the depository participant for demat shares, checks two sets of names: the deceased's name on the share certificate, demat account and death certificate, and each heir's name on PAN, Aadhaar and their demat account. A father recorded as "S. K. Ghosh" on the certificate and "Sunil Kumar Ghose" on the death certificate, or a daughter whose married name differs from her PAN, can hold up the claim. This page shows how heirs in West Bengal can line up the names.

Shares Transmission Name Mismatch (Quick Answer)
For transmission of shares after a death, the heir files Form ISR-5 with the company's registrar (or applies to the DP for demat shares), with the death certificate, their own KYC and the share papers. A registrar's checklist says the heir's name on PAN, Aadhaar and demat account must be the same. If the deceased's name differs between the certificate and the death certificate, correct the death certificate or give an affidavit. Without a nominee, claims above a value limit need a succession certificate or similar; SEBI reportedly raised these limits in June 2026.

| Problem | Fix |
|---|---|
| Deceased in initials on certificate | Affidavit linking the names |
| Death certificate spelling differs | Correct it or give an affidavit |
| Heir's PAN, Aadhaar, demat differ | Make all three match first |
| Married daughter's surname changed | Marriage proof with her KYC |
| No nominee, high value | Succession papers as the limit requires |
Transmission of Shares After a Death in West Bengal: Not a Transfer
Transmission is how shares move to a nominee or legal heir after the holder dies. It is different from a transfer, which is a sale or gift between living people.
For physical shares, the heir applies to the company's registrar and transfer agent (RTA). For demat shares, the heir applies to the depository participant where the deceased had the demat account.
In both cases, the office checks that the deceased on the share record is the same person as on the death certificate, and that the heir's identity papers agree with each other.
Old certificates often carry initials or old spellings, so name checks can cause delays.
Deceased Shareholder's Name Differs on Share Certificate, Death Certificate and PAN
The share certificate or demat account may say S K Ghosh, the death certificate Sunil Kumar Ghose, and the PAN a third form. Each difference needs explaining.
If the death certificate itself is wrong, ask the Registrar of Births and Deaths that registered the death to correct it; the West Bengal portal is janma-mrityutathya.wb.gov.in. Where the papers cannot be changed, an affidavit by the heir linking the names is the usual bridge; see one and the same person affidavit.
Bengali surnames often appear in two spellings; see Bengali and English name differences. Keep any other paper that shows both forms, such as an old passport or pension order.
Legal Heir's Name on PAN, Aadhaar and Demat Account Must Match
A registrar's checklist says plainly that the heir's name on PAN, Aadhaar and the demat account must be the same. The shares are credited to the heir's demat account, so that account must exist and match.
A daughter whose surname changed after marriage should first update her Aadhaar and PAN, then her demat account; see demat account name change. Her marriage certificate links her name in the family papers to her current name.
If an heir is a minor, the guardian's KYC is needed as well.
Share Transmission to a Nominee or, Without One, to Legal Heirs
With a registered nominee, transmission is simpler: the checklist lists the death certificate, the nominee's KYC, the share papers or demat details and a cancelled cheque.
Without a nominee, the legal heirs need more: affidavits from each heir, an indemnity bond, no-objection letters from heirs who are not claiming, and for higher values, a succession certificate, probate, letter of administration or legal heir certificate.
Succession certificates are court matters and a lawyer's job. The District Legal Services Authority gives free legal aid to eligible people.
SEBI Simplified Transmission Limits and the 2026 Change: Rs 10 Lakh Physical, Rs 30 Lakh Demat
Under the earlier SEBI framework, a registrar's checklist shows that up to Rs 5 lakh for physical shares and Rs 15 lakh for demat, heirs could use no-objection letters or a family settlement deed with an indemnity bond, without succession papers.
A June 2026 report says SEBI raised these limits to Rs 10 lakh per listed company for physical holdings and Rs 30 lakh per beneficial owner for demat, added a quick process for very small claims, and replaced several forms with one combined affidavit and NOC. The same report says probate is no longer required.
Sources differ on the date and details, so ask the registrar or DP which rules they are applying to your claim before you prepare papers.
Share Transmission Forms: ISR-5, ISR-2 and Heir Affidavits
The registrar's checklist lists Form ISR-5 as the transmission request, ISR-2 for banker confirmation of signature, and annexures for the heirs' affidavit, the indemnity bond and no-objection letters, with notarisation on stamp paper.
After the 2026 changes, some of these may be replaced by a single combined affidavit; check with the registrar.
For old physical certificates, KYC with the registrar uses Form ISR-1; see share certificate name change.
Shares Already Moved to IEPF: Transmission First, Then the Refund Claim
If dividends went unpaid for seven years, the shares may have been moved to the Investor Education and Protection Fund. A guide says transmission to the heir must be completed before the IEPF claim.
So finish the transmission papers first, then file the IEPF claim; see IEPF refund name mismatch.
Mutual fund units follow a similar transmission process with each fund house; see mutual fund folio name change.
