Will and Probate Name Mismatch in Kolkata

For a century, a Hindu will made in Kolkata or the old Bengal territory had to be probated before anyone could claim under it. In December 2025 Parliament removed that rule. Some offices may not have caught up, and older guides still say probate is compulsory. Meanwhile the old problem remains: the will names the father as "Haru", his deed says "Haradhan", and the daughter in the will now carries her husband's surname. This page explains the new position and how to link the names.

Will and Probate Name Mismatch (Quick Answer)

Section 213 of the Indian Succession Act, which made probate compulsory for many wills in Kolkata and Bengal, was omitted by the Repealing and Amending Act, 2025. Probate is now optional, though some banks and offices may still ask for it. If the will names the testator or a beneficiary differently from their deed or Aadhaar, link the names with a one and the same person affidavit and supporting papers; a probate court can also settle identity once and for all.

Is Probate Compulsory in Kolkata? Section 213 Omitted by the Repealing and Amending Act, 2025

Section 213 of the Indian Succession Act, 1925 said no right as executor or legatee could be established in court unless probate had been granted. Read with Section 57, this applied to wills by Hindus, Buddhists, Sikhs and Jains made in the old Bengal territories and the presidency towns, which made probate a routine step for Kolkata families.

The Repealing and Amending Act, 2025 (Act 37 of 2025, assent reported as 20 December 2025) omitted Section 213.

A commentary by the law firm IndusLaw says the change works going forward: probates already granted and proceedings already pending are not affected.

So for a death or will being dealt with now, probate is a choice, not a must. Check the exact commencement with your lawyer for your case.

Why Some Guides Still Say Probate Is Compulsory in West Bengal

Many probate guides for the Calcutta High Court, including ones written as recently as September 2025, still say probate is mandatory in West Bengal. They were written before the repeal.

News reports from December 2025 and law firm notes since then say probate is no longer mandatory. We follow the newer position, and name the conflict here so you can show it to an office that still relies on an old guide.

If an office refuses to act without probate, ask for the refusal in writing and take legal advice. Applying for probate is still open to you if that is quicker than arguing.

When Probate Still Helps in Kolkata, Especially With Name Mismatches

The same law firm notes that an unprobated will can still be challenged, sometimes years later, and that registrars, municipalities and banks may keep asking for probate for a while.

Probate can help most when names do not match. A court that grants probate has looked at the will, the testator's identity and the heirs. That order is hard for an office to second-guess.

In a probate case, all heirs who would inherit without a will must be cited. A Kolkata guide calls a failure to cite a necessary party a serious defect, so every heir's name must be right in the petition.

Testator's Name

Testator's Name in the Will Differs From the Property Deed

Older wills often use a short name, a pet name or a different spelling from the property deed or bank account. The will stays as written.

The executor or beneficiary links the names with a sworn affidavit, and supporting papers that show both names for the same person, such as a pension book, voter list or school record; see one and the same person affidavit.

For a big gap, such as a different surname, a probate court's finding may be the cleanest answer.

Beneficiaries

Beneficiary Named in the Will by Nickname, Maiden Name or Old Spelling

A will may name a daughter by her maiden name, or a grandson by a nickname. Years later their Aadhaar shows a different name.

The beneficiary swears an affidavit linking the names, with the marriage certificate or school record. See Aadhaar name change after marriage for the ID side.

If a named beneficiary has died before the testator, that share may not pass the way the family expects. That is a lawyer's job; the District Legal Services Authority gives free legal aid to eligible people.

New Wills

Writing a New Will in West Bengal: Get Every Name Right

Write your own name as on Aadhaar and add "also known as" for every other version used in your deeds, bank accounts and shares.

Name each beneficiary as on their Aadhaar, with relationship and father's or husband's name. Describe the property as in the deed and khatian.

Registering a will is optional, but it helps prove the will later. Keep it safe and tell the executor where it is.

Records

Mutation, Bank Accounts and Shares Under a Will With a Name Mismatch

After a death, the beneficiary applies for mutation: at the BL&LRO for land, at the municipality for a house; see property tax and municipal mutation. Each office has its own forms. A state form for Salt Lake plots, for example, is meant for heirs where the lessee died without a will.

For shares and demat, see shares transmission for heirs. Banks have their own claim rules.

If some heirs agree to step aside instead of using the will, see release deed name mismatch.
