Name Correction in a Death Certificate in West Bengal

A death certificate is the first paper every family needs after a death: for the bank, the insurer, the pension office, the RTO, the land record and the succession court. If it spells the person's name differently from their Aadhaar, passbook or policy, each of those offices may stop and ask questions. This page explains who corrects a death certificate in West Bengal, the difference between a clerical slip and an error of substance, what to file, and when an affidavit is enough instead of a correction.

How to Correct a Name in a Death Certificate in West Bengal (Quick Answer)

Apply to the Registrar of Births and Deaths of the body that registered the death, which is usually where the death happened, not where the person lived: KMC in Kolkata, otherwise the municipality or gram panchayat. A clerical slip is corrected on enquiry; an error of substance needs a declaration by two credible persons under Rule 12 of the West Bengal rules. Attach the deceased's Aadhaar and other ID. If only one office objects, an affidavit may be enough.

Who Corrects It

Who Corrects a Death Certificate in West Bengal

Deaths are registered by Registrars appointed under the Registration of Births and Deaths Act, 1969 and the West Bengal Registration of Births and Deaths Rules, 2000: the Kolkata Municipal Corporation in Kolkata, municipalities and notified area authorities in towns, and gram panchayats in rural areas.

Only the Registrar who holds the entry can correct it. That is the office for the place where the death happened. If someone from Nadia died in a Kolkata hospital, the entry is with KMC, not with the home panchayat.

West Bengal runs birth and death records through the Health and Family Welfare Department's Janma-Mrityu Tathya portal, and KMC for Kolkata. Many offices accept correction applications there; others want a visit.

Why It Matters

Why a Name Error in a Death Certificate Causes Trouble

Every claim after a death starts by matching the death certificate to the deceased's records. A bank compares it with the account, an insurer with the policy, the pension office with the pension order, the RTO with the RC.

When the death certificate says "Shyamal Kr. Ghosh" and everything else says "Shyamal Kumar Ghose", each office may hold the claim. See widow pension name mismatch, PMJJBY and PMSBY claims and RC transfer after the owner's death.

So check the certificate carefully the day you receive it. Corrections are much easier while the hospital and informant still remember the details.

Types of Error

Clerical Slip or Error of Substance

Rule 12 of the West Bengal Registration of Births and Deaths Rules, 2000 separates two kinds of error. A clerical or formal error, such as a typing slip, is corrected by the Registrar after enquiry.

An error of substance, such as a wrong surname, needs a declaration setting out the error, made by two credible persons who know the facts, along with supporting documents.

In practice, offices also ask for the deceased's Aadhaar, voter ID or other ID showing the correct name. The Registrar records the correction in the register and issues a corrected certificate.

How to Apply

How to Apply for a Death Certificate Name Correction

Find the registration details on the certificate: registration number, date and the registering body. Apply to that Registrar, on the Janma-Mrityu Tathya portal where the office uses it, or at the office.

Attach a copy of the certificate, the deceased's ID in the correct name, the applicant's ID and relationship proof, and for an error of substance, the declaration of two credible persons. Ask the office for its own list; it varies.

For how the same Registrar corrects birth records, see birth certificate name change. The rules are the same.

Affidavit

When an Affidavit Is Enough Instead of a Correction

If the difference is small and only one or two offices object, an affidavit by the heir linking the names may be faster than a correction. Many banks, insurers and RTOs accept it.

See one and the same person affidavit. Keep several attested copies; each office keeps one.

For a big difference, such as a wrong surname or the wrong father's name, correct the certificate. A court or succession proceeding will look closely, see succession certificate name mismatch.

Hospital Deaths

Deaths in Hospital: Where the Name Usually Goes Wrong

For a death in hospital, the hospital reports it to the Registrar, often with the name from the admission form, typed in a hurry by staff or written by a relative under stress.

If the name on the hospital record is wrong, the death certificate will be wrong too. Ask the hospital for a copy of the record and, where possible, a letter confirming the correct name; it supports your correction.

A gazette notification is not the route for correcting a death certificate. The Registrar corrects its own register.
