Vehicle RC Transfer After the Owner's Death in West Bengal
When the registered owner of a car, scooter or truck dies, the vehicle does not pass to the family by itself. The RC has to be transferred to the person who succeeds, through the RTO, using Form 31, and there are time limits. In West Bengal families the paperwork often trips on names: the father's name on the RC does not match the death certificate, or the heir's Aadhaar spells the surname differently. This page explains the transfer, the 2021 nominee rule, the documents, and how to handle name mismatches without delay.

How to Transfer a Vehicle RC After the Owner Dies (Quick Answer)
The person succeeding to the vehicle should inform the RTO within 30 days of the death and apply in Form 31 within 3 months, with the death certificate, the original RC, insurance, PUC and proof of succession: the nominee if one is recorded on the RC, otherwise legal heir papers and no objection from other heirs. If names differ across these papers, add an affidavit linking them.
| Situation | What the RTO usually needs |
|---|---|
| Nominee is recorded on the RC | Form 31, death certificate, nominee's ID |
| No nominee, one heir | Form 31, death certificate, legal heir proof |
| No nominee, several heirs | Plus no objection from the other heirs |
| Deceased's name differs on RC and death certificate | Affidavit linking the names |
| Vehicle on loan | Financier's no objection or loan closure first |
Transfer of Vehicle Ownership on Death: The Rule and Time Limits
Under the Central Motor Vehicles Rules, when the registered owner dies, the person succeeding to the vehicle may use it for a short period, but must inform the registering authority within 30 days of the death and apply for transfer in Form 31 within three months.
This is a transfer of ownership, not a correction of the owner's name. The RC will be reissued in the new owner's name; for corrections of a living owner's name, see name change in vehicle RC.
In West Bengal the application is made through the Parivahan vehicle services portal for your RTO, followed by a visit with originals where the RTO asks.
The 2021 Nominee Rule for Vehicles
Amendments to the Central Motor Vehicles Rules in 2021 let a vehicle owner name a nominee on the registration, at purchase or later through an online application. On the owner's death, the nominee informs the registering authority within 30 days and applies in Form 31 within three months.
A nominee makes the transfer much simpler, because the RTO does not have to decide among heirs. If your family vehicles have no nominee, add one now through the portal.
A nominee holds the vehicle for the family. Any dispute among heirs over who finally owns it is a legal matter, not an RTO one.
Documents for RC Transfer After Death
Guides on the process list the original RC, the death certificate, the insurance certificate, a valid PUC, the new owner's address and identity proof, photographs, and proof of succession.
Proof of succession is the nominee record if there is one; otherwise legal heir documentation, and no objection from the other heirs. Some RTOs may ask for a succession certificate; see succession certificate name mismatch.

When Names Do Not Match on the RC, Death Certificate and Heir Papers
West Bengal families often find that the RC says "Sk. Abdul Rahaman", the death certificate says "Sheikh Abdul Rahman", and the heir's Aadhaar has a third spelling of the surname. The RTO must be sure all these refer to the same people.
An affidavit by the applicant stating that the different spellings belong to the deceased, and giving the documents that carry each, usually satisfies the RTO; see one and the same person affidavit and Md, Mohd, Sk and Sheikh spellings.
If the death certificate itself is wrong, it is corrected by the body that registered the death. That is a separate job and can take longer than the RTO's three months, so start early.
Vehicle on Loan When the Owner Dies
If the RC shows a financier (hypothecation), the bank or NBFC has an interest in the vehicle. The transfer usually needs the financier's no objection, or the loan closed first.
Many vehicle loans carry loan protection insurance that may close the loan on death. Ask the lender before paying anything.
Once the loan is settled, the financier issues the papers needed to remove hypothecation, and the transfer can proceed.
Insurance, FASTag and Other Records After the Transfer
Motor insurance should be transferred to the new owner's name by endorsement with the insurer. A claim on a policy still in the deceased's name can be disputed.
The FASTag in the deceased's name should be closed and a new one taken; see FASTag KYC name mismatch.
The new owner's own driving licence is separate and does not change; see name change in driving licence.
