Patta Name Mismatch in West Bengal

A patta is land given by the government, not bought. In West Bengal it may be a vested land patta under the Land Reforms Act, a Nijo Griha Nijo Bhumi homestead patta, a tea garden homestead patta, a forest rights title, or a refugee colony deed. Many of these were written in Bengali, often in a husband and wife's joint names. Years later the spelling does not match Aadhaar, the holder has died, or the wife's surname has changed. This page shows which record to fix, and where.

Patta Name Mismatch (Quick Answer)

A patta in West Bengal is a government land grant, and the name on it is carried into the khatian (record of rights). If the patta or khatian spells your name differently from Aadhaar, ask the BL&LRO for a record correction and use a one and the same person affidavit for the gap. If the patta holder has died, heirs apply for mutation by inheritance. Patta land usually passes to heirs but cannot be freely sold, so a gazette rarely helps here.

The Basics

What a Patta Is, and the Kinds Found in West Bengal

A patta is a document by which the government settles land on a person. You did not buy it, so there is no sale deed behind it. The patta itself is your proof of title, along with the land record.

The common kinds in West Bengal are vested land pattas settled under the West Bengal Land Reforms Act, 1955 (Section 49), and homestead pattas under Nijo Griha Nijo Bhumi, launched on 18 October 2011 for landless agricultural labourers, village artisans and fishermen. The state scheme page says each eligible family gets 5 decimals.

There are also homestead pattas for tea garden workers in North Bengal (a scheme notified on 1 August 2023), titles under the Forest Rights Act, 2006, and title deeds for families in refugee colonies.

Each kind has its own issuing office, so first look at your patta and see who signed it and under which law.

The Record

Patta vs Khatian on Banglarbhumi: Which Name Record Counts

The patta is a one time grant. The record that is checked again and again is the khatian (record of rights) on Banglarbhumi. The Nijo Griha Nijo Bhumi scheme page says pattas, record of rights and possession certificates are handed over on the spot.

So when a bank, a scheme or an office checks your land, they usually look at the khatian. If the khatian shows your name correctly, a small spelling slip on an old paper patta is easier to explain.

For how land record corrections work, see mutation and name correction on Banglarbhumi.

Spelling

Patta Name Spelling Does Not Match Aadhaar: Bengali to English Gaps

Pattas were mostly written in Bengali. When an office types the name in English, it may come out differently from your Aadhaar. This is a format difference, not a different person.

Two papers usually settle it. One is a record correction at the BL&LRO if the khatian itself is wrong. The other is a one and the same person affidavit linking the patta spelling to your Aadhaar; see one and the same person affidavit.

If the gap comes from Bengali and English writing, read Bengali and English name differences before you change anything.

Joint Pattas

Joint Patta in the Names of Wife and Husband: Nijo Griha Nijo Bhumi

The Nijo Griha Nijo Bhumi scheme says pattas are given in the name of the female head of the household, or jointly in the names of wife and husband. The tea garden homestead scheme, as reported by a workers' union, also puts women's names on the deed.

This creates a common mismatch. The wife's name on the patta may carry a title such as Devi or Dasi, or her father's surname, while her Aadhaar now shows her husband's surname. A sworn affidavit that both names are the same woman is the usual bridge.

If you are changing your surname after marriage on Aadhaar too, see Aadhaar name change after marriage. Do not try to drop the wife's name from a joint patta to make paperwork easier; the joint name protects her right.

Inheritance

Patta Holder Has Died: Heirs and the July 2025 Calcutta High Court Ruling

A July 2025 Calcutta High Court judgment on a Section 49 patta said that heirs succeeding to the patta by inheritance did not break the Act's transfer limits. So patta land does pass to heirs.

The heirs apply to the BL&LRO for mutation by inheritance, with the death certificate and proof of who the heirs are. Each heir's name should be spelt the way it appears on their own ID.

Disputes between heirs are a lawyer's job. The District Legal Services Authority gives free legal aid to eligible people.

Transfer Limits

Can Patta Land Be Sold or Transferred in West Bengal? Section 49 Limits

Usually not freely. The same High Court judgment notes that Section 49 limits transfer of settled land, and that the patta deed carries terms that let the State start proceedings to annul the patta. The tea garden scheme deeds are reported as heritable but not transferable. The Forest Rights Act, Section 4(4), says the right is heritable but not alienable or transferable.

So if someone offers to buy patta land and asks you to first "fix the name", stop and take legal advice. A name correction does not make patta land saleable.

If you were sold patta land in the past, a name fix will not solve the bigger problem. Speak to a lawyer.

Special Pattas

Tea Garden, Forest Rights and Refugee Colony Patta Names

Tea garden homestead pattas in North Bengal were notified in August 2023, with handover reported from February 2024. Check names at the block or BL&LRO office that held the camp.

Forest rights titles are issued through the Forest Rights Act committees. Section 4(4) says the title is registered jointly in both spouses' names for married persons. Ask the office that issued your title about a name error.

Refugee colony deeds: in Bina Basak v. Bipul Kanti Basak (21 March 2024), the Supreme Court held that a rehabilitation plot in a Siliguri colony was meant for the whole family, not only the person whose name was recorded. So a name on such a deed may not settle who owns it. Take legal advice before relying on it alone.

Gazette

Do You Need a Gazette for a Patta Name Mismatch?

Usually no. A gazette is supporting proof, not a correction; it rewrites no land record. The BL&LRO corrects the khatian on its own evidence, and an affidavit explains small spelling gaps.

A gazette helps only if you have really changed your name, for example a new surname, and an office asks for it in writing. Then the state route is the Kolkata Gazette Part II.
