Land Acquisition Compensation Name Mismatch in West Bengal
When the government takes land for a road, rail line, canal or factory in West Bengal, the money goes to the person shown as owner, into a bank account. If the khatian says one spelling, the bank account another, and the owner has died, the payment can get stuck. Under the state's Direct Purchase Policy, delay can also cost you an extra incentive. This page shows which names must match, and in what order to fix them.

Land Acquisition Compensation Name Mismatch (Quick Answer)
Land compensation in West Bengal is paid to the owner recorded in the khatian, into a bank account. So the khatian, deed, bank account, PAN and Aadhaar should show the same name. Fix a wrong khatian spelling at the BL&LRO, get mutation if the owner has died, and link small gaps by affidavit. Under the Direct Purchase Policy, a 50% incentive applies only if the sale is registered within 30 days, so start early.

| Problem | Fix |
|---|---|
| Khatian spelling differs from bank account | BL&LRO record correction or bank update |
| Recorded owner has died | Mutation in heirs' names first |
| Heirs disagree | Money may be deposited with the Authority |
| PAN or Aadhaar spelling differs | Fix Aadhaar and PAN, then the bank |
| Old deed in an old name | Affidavit linking the names |
Direct Purchase Policy 2016 or RFCTLARR Act: How Land Is Taken in West Bengal
West Bengal mostly buys land from owners under its Direct Purchase Policy, notification 756-LP/1A-03/14(Pt-II) dated 25 February 2016. A district committee headed by the District Magistrate fixes the price, and a Zilla Parishad, municipality or similar body buys the land.
A July 2026 news report says the new state government also plans to use this policy for industry land, instead of forcible acquisition.
Some projects still use compulsory acquisition under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (RFCTLARR Act). Central projects such as highways or railways may use their own laws. Ask the notice issuer which law applies to your land.
Whichever route it is, the money goes to the person the record shows as owner.
Who Gets Land Compensation in West Bengal: The Owner Recorded in the Khatian
Under the Direct Purchase Policy, the BL&LRO verifies the right and title of the selected land within 14 days, and payment is made to the owners' bank accounts.
Under the RFCTLARR Act, Section 77 says the Collector pays the persons entitled by depositing the amount in their bank accounts.
So the khatian is where it starts. If it shows someone else, or a wrong spelling, fix it first; see mutation and name correction on Banglarbhumi.
Khatian, Deed, Bank, PAN and Aadhaar: Names That Must Match for Compensation
Line up five papers: the khatian, your deed or patta, the bank account, PAN and Aadhaar. A gap between any two can hold up the file.
Fix them in this order: Aadhaar and PAN first, then the bank account, then the land record. For PAN and Aadhaar gaps, see PAN and Aadhaar name mismatch; for the bank, see name change in bank records.
Where an old deed carries an old spelling, a sworn affidavit linking it to your current ID usually explains it; see one and the same person affidavit.
Name Mismatch Can Cost the 50% Direct Purchase Incentive
The Direct Purchase Policy gives an extra incentive on the price: 50% if the sale is registered within 30 days, and 10% if registered within 31 to 60 days.
If your name problem takes two months to fix, you may lose most of that incentive. That is why checking names the day a notice or survey reaches your village matters.
Check your khatian on banglarbhumi.gov.in as soon as you hear your land may be bought.
Recorded Owner Has Died: Mutation by Inheritance Before Compensation
If the khatian still shows a dead parent or grandparent, the heirs should apply for mutation by inheritance at the BL&LRO, with the death certificate and proof of heirs.
Each heir's name in the new record should match that heir's Aadhaar and bank account, because each one may be paid separately.
For the same problem in other assets, see shares transmission for heirs.
Title Disputes Under Section 77(2): When Compensation Is Deposited, Not Paid
Under Section 77(2) of the RFCTLARR Act, if there is a dispute about title or about how the money is shared, the Collector deposits the compensation with the Authority instead of paying it.
A name mismatch alone is not a dispute. But if two people claim the same land, or heirs disagree, the money can wait until it is settled.
Title disputes are a lawyer's job. The District Legal Services Authority gives free legal aid to eligible people.
Patta Holders and Bargadars in Land Purchase
A clarification memo SS-215-LA dated 13 March 2025 says that for patta land, the government should first try to resettle the holder on other government land. If none is available, the holder gets compensation as a free hold raiyat with a 10% incentive.
The same memo says recorded bargadars are compensated under para 74 of Chapter V of the West Bengal Land Acquisition Manual, 1991.
For patta name problems, see patta name mismatch. A bargadar's name must also be correct in the record to be counted.
Land Compensation Not Paid in West Bengal: Write to the SLAO
Keep a copy of every notice, the khatian and your bank details, and write to the Special Land Acquisition Officer (SLAO) or the district land acquisition section.
In one case decided on 21 December 2023, the Calcutta High Court told a Special Land Acquisition Officer to communicate his decision within four weeks, and pay within two months after that if money was due.
Going to court is a lawyer's job. Many delays end once the names and records are in order.
