Change of Gender in West Bengal: The Statutory Certificate Is Not the Same as a Gazette

The Transgender Persons (Protection of Rights) Act 2019 provides for a certificate of identity and an identity card issued by the District Magistrate, applied for through a national portal that is free to use and available in Bengali. A gazette notification is a different instrument. Many people are sold the second when the first is what actually does the work.

Change of Gender in West Bengal (Quick Answer)

There are two separate instruments and they do different jobs. The Transgender Persons (Protection of Rights) Act 2019, in force since 10 January 2020, lets you apply to your District Magistrate for a certificate of identity, and section 6(3) says that certificate confers rights and is proof of recognition of your identity. Applications go through the national portal at transgender.dosje.gov.in, which is available in Bengali. Section 4(2) of the Act states a right to self-perceived gender identity. A gazette notification is separate: Part II of the Kolkata Gazette does cover change of gender, and is useful where you are also changing your name or where an authority specifically asks for one. You may not need both.

What the Transgender Persons Act 2019 Provides for Change of Gender

The Transgender Persons (Protection of Rights) Act 2019 came into force on 10 January 2020, with the Rules of 2020 made under it.

Three provisions matter most here, and they are worth reading in the Act's own terms.

Section 4(2) states that a person recognised as transgender shall have a right to self-perceived gender identity.

Section 5 provides that a transgender person may make an application to the District Magistrate for a certificate of identity. Where the applicant is a minor child, the application is made by a parent or guardian.

Section 6(3) states that the certificate issued shall confer rights and be a proof of recognition of the person's identity.

Why we quote the sections

So you can check them yourself, and so you can point to them if an office is unsure. The Act is published and free to read, and the link is in our sources below.

Two Certificates

Section 6 Transgender Certificate and Section 7 Revised Gender Certificate

The Act provides for two different certificates, and knowing which one you are asking for saves a great deal of confusion.

The section 6 certificate is issued by the District Magistrate on a section 5 application, and it indicates the gender as transgender.

The section 7 certificate is a revised certificate indicating a change of gender as male or female. Under the Act, this applies where a person has undergone surgery to change gender, and the application goes to the District Magistrate together with a certificate to that effect from the Medical Superintendent or Chief Medical Officer of the medical institution where the surgery was performed. The Magistrate, on being satisfied of its correctness, issues the certificate.

On the medical certificate itself, the portal's own guidance says there is no specific format, that district authorities may verify it if required but that this is not mandatory, and that doctors' notes can be considered for applicants treated abroad.

Ask which one you need

Before preparing anything, ask your District Magistrate's office which certificate applies to your situation and what it wants to see. That conversation is free and it decides everything after it.

Where You Apply

National Portal for Transgender Persons: Free to Apply, Available in Bengali

Applications are made through the National Portal for Transgender Persons at transgender.dosje.gov.in, run by the Ministry of Social Justice and Empowerment. The portal describes itself as the facilitator between district authorities and applicants for the certificate and identity card, issued as per self-perceived identity.

Two practical things about it. It works on a phone, computer or laptop, so no office visit is needed to apply. And it is available in several languages including Bengali, alongside English and Hindi.

We put that second point in bold because it matters commercially. If somebody offers to complete an English form on your behalf for a fee, you should know the portal already speaks your language. You register, apply and track the status through your own login, without asking anyone.

The manual is free too

The portal publishes a step-by-step user manual and the affidavit formats as downloads, along with the Act and the Rules. Nobody should be charging you for those.

The Application

Documents for the Gender Certificate Application: Form-2 Affidavit and Residence

For a section 5 application, the portal names the filled application together with an affidavit in the Form-2 format.

On residence, the applicant must be residing in the area under the jurisdiction of that District Magistrate on the date of application, and the Form-2 affidavit covers that point.

The affidavit formats for both routes are published on the portal as downloads, so you can see exactly what is being asked before you have anything sworn.

Read the format first

Download the format, read it, then get the affidavit made. Doing it the other way round is how people end up paying twice for the same document.

Being Straight With You

Is a Section 6 Certificate Needed Before a Section 7 Certificate?

There is a question we cannot answer cleanly, and we would rather say so than guess.

The Act introduces section 7 with the words after the issue of a certificate under sub-section (1) of section 6, which reads as though the section 6 certificate comes first. The portal's own frequently asked questions, however, indicate that holding a transgender certificate is not mandatory for the revised certificate.

We are not going to invent a resolution to that. Ask your District Magistrate's office directly what it requires in your case, and get the answer before you prepare or pay for anything.

If the position turns out to matter to you and the office is unclear, that is a point on which proper legal advice is worth having.

Free legal help

District Legal Services Authorities provide legal aid free of charge, and every district in West Bengal has one.

The Other Instrument

Change of Gender in the Kolkata Gazette Part II: When You Need It

Part II of the Kolkata Gazette does cover change of gender. The guidelines list it alongside change of name, change of religion and the other matters Part II publishes. So a West Bengal resident who wants a gazette notification can obtain one through the ordinary Part II process, at the ordinary fee.

But it is worth being clear about what a gazette does. It publishes a change. It is supporting proof, the same as for every other subject on this site, and it rewrites no register by itself.

Where a gazette genuinely helps: when you are also changing your name, which the statutory certificate does not do on its own; and where a particular authority specifically asks for one.

Where it may not be needed: where the statutory certificate is what the office in front of you actually wants. Ask before you buy.

What the Kolkata Gazette is and what Part II covers, and the guidelines clause by clause.

The name is a separate decision

Changing your name and changing the gender recorded are two things. You may want one, the other, or both, and they are handled by different instruments.

Afterwards

Updating Aadhaar, PAN and Other Records After a Change of Gender

Once you hold the certificate, updating records follows the same order as everything else on this site.

Aadhaar first, then PAN, because most other records are checked against those two. Then bank, employer, voter ID and the rest, each applied for separately.

Expect it to take time and expect to explain yourself more than once. That is the reality of any change that touches many registers, and it is not a sign anything has gone wrong.

The Aadhaar route and the birth certificate route, which is decided by the body that registered the birth.

Keep copies

Of the certificate, the ID card and every acknowledgement. You will be asked for them repeatedly, by different offices, over a long period.

Plainly

What a Gazette Consultant Can and Cannot Do for a Change of Gender

What we can do. Prepare and check documents: affidavits in the published formats, a gazette application where you decide you want one, and the paperwork for updating records afterwards.

What we cannot do. Advise you on your rights. Influence a District Magistrate. Promise a timeline. Or tell you which route is right for you as a matter of law, because that is a lawyer's work and we are a documentation consultancy.

What you may not need us for at all. The portal is free, it is in Bengali, the manual and affidavit formats are published, and the application is trackable from your own login. If that is all your situation requires, you can do it yourself, and we would rather tell you that.

If you are being refused a service or a document, that is a legal matter and the Act itself contains provisions against discrimination. District Legal Services Authorities provide free legal aid in every district.

Three questions for anyone you pay

Which instrument does my case need, and why? What is the government fee and what is your fee, as two numbers? And what exactly will you do that I cannot do on the portal myself? More on judging a consultant.

FAQ & People Also Ask

Change of Gender in West Bengal: Frequently Asked Questions

What does the law actually provide?

The Transgender Persons (Protection of Rights) Act 2019, in force since 10 January 2020, with the Rules of 2020. Section 4(2) states that a person recognised as transgender has a right to self-perceived gender identity. Section 5 lets you apply to the District Magistrate for a certificate of identity, and section 6(3) says that certificate confers rights and is proof of recognition of your identity.

Where do I apply?

On the national portal at transgender.dosje.gov.in, run by the Ministry of Social Justice and Empowerment. It acts as the link between you and the district authorities for the certificate and the identity card. You register, apply and track your application through your own login.

Is the portal available in Bengali?

Yes. The portal states it is available in several languages including Bengali, alongside English and Hindi. That matters here, and it is worth knowing before anyone offers to fill an English form on your behalf for a fee.

What documents does the section 5 application need?

The portal names the filled application together with an affidavit in the Form-2 format. You must be residing in the area under the jurisdiction of that District Magistrate on the date of application, and the affidavit covers that. Affidavit formats are downloadable from the portal itself.

Can a minor apply?

The Act provides that where the applicant is a minor child, the application is made by a parent or guardian.

What is the revised certificate under section 7?

The certificate under section 6 records the gender as transgender. Section 7 deals with a certificate indicating a change of gender as male or female. Under the Act, that applies where a person has undergone surgery to change gender, and the application goes to the District Magistrate with a certificate to that effect from the Medical Superintendent or Chief Medical Officer of the institution where the surgery was performed.

Is there a prescribed format for that medical certificate?

The portal's own guidance says there is no specific format for the medical certificate obtained from the hospital, that district authorities may verify it if required but that verification is not mandatory, and that doctors' notes can also be considered for applicants treated abroad.

Do I need the section 6 certificate before applying under section 7?

The Act reads as though the section 6 certificate comes first, while the portal's frequently asked questions indicate that holding one is not mandatory for the revised certificate. We are not going to invent a resolution to that. Ask your District Magistrate's office directly what it requires, and get the answer before you prepare anything.

Do I need a gazette notification as well?

Not necessarily, and this is where people spend money they need not. The statutory certificate is the instrument the Act creates and it is what many institutions will ask for. A gazette is a separate thing: it publishes a change of name or gender in the official gazette. It is useful where you are also changing your name, or where a particular authority insists on one.

Does the Kolkata Gazette cover a change of gender?

Yes. The Part II guidelines list change of gender among the matters that can be published, alongside change of name, change of religion and the rest. So a West Bengal resident who wants a gazette notification can obtain one through the ordinary Part II process.

Which should I do first?

Deal with the certificate first where the statutory route fits your situation, because it is the document the Act gives rights to. Then update records in the usual order, Aadhaar and PAN before the rest, since most other records are checked against them.

Someone has refused me a service or a document because of this. What can I do?

That is a legal question rather than a documentation one, and the Act itself contains provisions against discrimination. Speak to a lawyer, or to the District Legal Services Authority in your district, which provides legal aid free of charge. We can prepare documents; we cannot advise you on your rights, and we will not pretend otherwise.
