Name Change in Property Documents in West Bengal: A Registered Deed Is Not Rewritten
People arrive wanting their name changed on a property deed. It is the wrong question. A deed records a transaction that happened on a date, between the people who signed it that day, and it correctly names the person you were then. Nothing about a later change of name makes it wrong. What you actually need is a link between the two names, and then the records that read the deed afterwards.

Name Change in Property Documents (Quick Answer)
The registered deed is not altered. It records who you were on the day you signed, and that remains true. Establish a link between the old name and the new one, ordinarily a gazette notification, or a marriage certificate where the names differ for that reason. Then update the records that read the deed: the land record, the Khatian or Porcha, through the Block Land and Land Reforms Office and Banglarbhumi; the municipal or panchayat tax record, which is a different body entirely; and then utilities, the housing society and any loan. A rectification deed is for a genuine error in the deed itself, not for a later change of name, and it is a lawyer's job. Keep the link document filed with the deed permanently.

| Record | Held by | What a name change means here |
|---|---|---|
| The registered deed | Sub-Registrar, Directorate of Registration and Stamp Revenue | Nothing. It stays as executed |
| Khatian or Porcha, the Record of Rights | Block Land and Land Reforms Office, via Banglarbhumi | An application to correct the recorded name |
| Municipal or panchayat tax record | KMC, your municipality or the panchayat | A separate application to that body |
| Electricity and other utilities | The utility | Its own name change process |
| Housing society or apartment association | The society | Its own records and share certificate |
| Home loan or mortgage record | Your bank | Handled with the bank's KYC update |

Can You Change the Name on a Registered Sale Deed? No
A deed is not a profile that should reflect your current details. It is an account of something that happened: on a date, these people signed, this consideration passed, this property was transferred. The name in it was accurate when the ink dried, and a change of name years later does not make the document false.
This is the same principle as a birth certificate. A record of the past states the past. A gazette states the present and the future. Asking one to rewrite the other is asking the wrong document to do the job, and a record that could be rewritten on request would be worth very little as evidence.
What people are actually worried about
Not the paper itself, but whether somebody later will accept that the person in the deed is them. That worry is real and it has an answer: the link document. It is just not an altered deed.
Rectification Deed: For a Mistake in the Deed, Not a Later Name Change
A rectification deed is a separate instrument, executed by the same parties and registered like any other, correcting a genuine error in the original: a wrong plot description, a misdescribed boundary, a name that was misspelt on the day.
It is not a device for recording that you changed your name afterwards, and it needs the cooperation of the other parties, who may be hard to find years later. Whether one is appropriate, and how it should be drafted, is a question for a property lawyer. We do not draft them and would not pretend otherwise.
Be careful who you ask
If somebody offers to "change the name on your deed" as a service, ask them exactly which instrument they intend to register and who will sign it. The answer will usually end the conversation.
Registration Office and Land Records: Two Different Departments
In West Bengal, registration sits with the Sub-Registrar under the Directorate of Registration and Stamp Revenue. Ownership records sit with the Block Land and Land Reforms Office, in the Khatian or Porcha, on the Banglarbhumi portal, under the Land Reforms Act.
They are separate systems and they do not update each other, and a name that looks wrong on Banglarbhumi is often not an error at all. That is why land is routinely registered in one person's name while the Record of Rights still shows another, sometimes for years, and it is why a name change has to be taken to each record separately.
A different problem people confuse with this
If the Khatian shows the seller's name rather than yours, that is not a name change at all. It usually means mutation was never completed after the purchase, and the fix is a mutation application, not anything to do with your own name.
Linking Your Old Name on the Deed to Your New Name
Since the deed stays as it is, everything rests on being able to show that the person named in it is you.
- A gazette notification, where you genuinely changed your name
- A marriage certificate, where a maiden and married name differ
- A decree, where a name was restored on divorce and the decree records it
- Identity documents carrying both names where any exist
One name, used everywhere
Whatever the new name is, spell it identically on the gazette, on Aadhaar, on the land record, on the tax record and in the bank. Property files are read by people who compare documents letter by letter, and a stray initial creates a query years later.
Updating Your Name in the Banglarbhumi Land Record
The Record of Rights is updated through the Block Land and Land Reforms Office, with applications routed through Banglarbhumi. Mutation, known locally as namjari or dakhil kharij, is the process that updates the recorded name, and a name correction is one of the grounds on which the record is amended.
Expect to produce the registered deed, the chain of earlier deeds where relevant, the current Khatian or Porcha, an up-to-date revenue or tax receipt, identity documents, and the prescribed fee, plus your link document. A physical verification of the property may form part of it, and the process commonly runs to around 30 to 60 days.
Check both sides
The portal and the office register can fall out of step, so confirm the entry has actually reached the record rather than trusting a status screen alone. Keep the application number.
Property Tax Record: Municipality or Panchayat Is a Separate Job
Property inside the Kolkata Municipal Corporation or another municipality has its assessment and tax record held by that body, not by the land office. Outside municipal areas the panchayat holds its own records.
So a flat owner in Kolkata and a landowner in a block are dealing with different authorities for what feels like the same task. Ask the body that sends you the tax bill what it needs, because that is the office whose record you are changing.
The bill tells you who to ask
Whoever issues your property tax demand is the authority for that record. It is the simplest way to work out which office your case belongs to.
Electricity, Gas, Housing Society and Home Loan Name Change
Once the official records are moving, the practical ones remain, and none of them updates itself:
- The electricity account, and water or gas where separately billed
- The housing society or apartment association, including its share certificate and members register
- Any home loan or mortgage record, handled with the bank's own name change
- Insurance on the property
Tenanted property
If the property is let, tell the tenant and update the rent agreement at renewal, so rent receipts and any future dispute name the person who actually owns it.
Is a Mutation Entry Proof of Ownership? No
Mutation matters, and without it the revenue record keeps reading the old name, which blocks ordinary things like a further sale or a loan. But a mutation entry is a revenue record kept for administrative purposes, and it is well settled that such an entry does not by itself create or prove title.
Ownership rests on the instruments of transfer, and where it is disputed, on what a civil court decides. So mutation is necessary housekeeping, not a title document, and anyone telling you a mutation certificate settles a title question is overstating what it does.
Where our work ends
We prepare gazette notifications and the documents that link your names. Title, rectification deeds, succession and any dispute are a property lawyer's work, and we will say so rather than take the job.
Keep the Gazette or Affidavit With Your Property Deed
This is the single most useful thing on the page. Put a copy of the gazette notification, or the marriage certificate, physically with the deed, and keep a scan with your digital copies.
Property documents are read decades later, often by somebody who never met you, sometimes after you are gone. The deed says one name; your heirs hold documents in another. The one sheet that connects them is what turns a problem into a formality.
Tell someone where it is
A file nobody knows about helps nobody. Whoever will handle your affairs should know the deed and the link document sit together.
Gazette Name Change for Property Documents, Step by Step
Needed where you have genuinely changed your name, since nothing else connects the person in the deed to the person you are now. For an adult resident of West Bengal with no passport involved, the Kolkata Gazette Part II publishes in about a week.
Fix the exact new name
Used identically on the affidavit, both newspapers, the gazette, Aadhaar, the land record and the tax record.
Affidavit before a First Class Judicial Magistrate
The Part II portal asks for the affidavit number and the Magistrate's name, so a notary will not serve for this route. Sign in the old name.
Notices in two daily newspapers
One Bengali and one English daily, complete pages kept with masthead and date.
Apply on the Part II portal
Change of Name, or Change of Surname where only the surname moves, with identity proof under 2 MB and a photograph under 100 KB.
Pay Rs 1,100 on GRIPS
The state fee. The Gazette of India applies instead where a passport is also changing, where the person is a minor, or where you live outside West Bengal, at 30 to 45 days.
File it with the deed, then update the records
Aadhaar first, then the land record and the tax record. Which gazette a case needs.
Property Documents Name Change: Frequently Asked Questions
Can I change my name on a registered property deed?
No, and you should not want to. A deed records a transaction that happened on a particular date between the people who signed it, and it correctly names the person you were then. It is a historical record, not a live profile. What you do instead is establish a link between the old name and the new one, ordinarily through a gazette notification, and then update the records that read the deed afterwards.
What is a rectification deed then?
A separate registered instrument used to correct a genuine error in an existing deed, such as a wrong plot description or a misspelling that was wrong on the day. It is executed by the same parties and registered like any other deed. It is not a way to record that you changed your name later, and drafting one is a lawyer's job, not ours.
So which records actually need changing?
In West Bengal, typically the land record, the municipal or panchayat tax record, and then the ordinary utility and financial records. Registration and land records are handled by two different departments on two different portals, so the deed and the Khatian are separate things and updating one does nothing to the other.
What is the difference between registration and mutation?
Registration is the recording of a deed by the Sub-Registrar, under the Directorate of Registration and Stamp Revenue. Mutation, called namjari or dakhil kharij, updates the Record of Rights, the Khatian or Porcha, through the Block Land and Land Reforms Office and the Banglarbhumi portal. The two offices do not talk to each other, which is why land can sit registered in your name and recorded in somebody else's for years.
Does mutation prove I own the property?
No. A mutation entry is a revenue record maintained for administrative purposes, and it is well settled that such an entry does not by itself confer or prove title. Ownership rests on the instruments of transfer and, where contested, on what a civil court decides. Anyone who tells you a mutation certificate settles a title question is overstating it.
Whose office handles my property?
It depends on where the property is. Land outside a municipal corporation runs through the Block Land and Land Reforms Office and Banglarbhumi. Property inside the Kolkata Municipal Corporation or another municipality is handled by that body for its own records. Ask locally rather than assuming, because applying to the wrong office wastes weeks.
What documents does a mutation application need?
Broadly the registered deed, the chain of earlier deeds where applicable, the current Khatian or Porcha, an up-to-date revenue or tax receipt, identity documents, and the prescribed fee, with succession documents where the change follows a death. The published requirements are on the Banglarbhumi portal and the office can confirm what your case needs.
How long does mutation take?
Commonly quoted at around 30 to 60 days, varying with the office and the type of application, and a physical verification of the property may form part of it. Take the application number and follow it up rather than assuming silence means progress.
My name changed after marriage. Is the deed a problem?
Not by itself. The deed names you as you were, and a marriage certificate ordinarily links the two names for most purposes. The practical work is updating the tax record, the utility accounts and the bank or loan record so nothing further down the line reads a name nobody can connect to you.
What if the Khatian shows the seller's name and not mine?
That is a different problem from a name change and a very common one. It usually means the deed was registered but mutation was never completed, so the fix is a mutation application at the land office rather than anything to do with the deed. Registration proved the transaction; mutation is what puts you in the record.
Do I need a gazette for this?
Where you have genuinely changed your name, yes, because nothing else links the person in the deed to the person you are now. Where the name simply differs between a maiden and married name, a marriage certificate usually does the linking. Where it is a clerical error in the deed itself, that is a rectification question for a lawyer.
What part of this do you handle?
The gazette notification, and the documentation that establishes the link between your old and new name. We do not draft rectification deeds, advise on title, or handle mutation applications, and we will tell you plainly when what you need is a property lawyer rather than a documentation service.
