FSSAI Licence Name Change in West Bengal
Every sweet shop, restaurant, tea stall, caterer and food maker in West Bengal holds an FSSAI registration or licence from the FoSCoS portal. When the business name, the owner's name or the owner changes, the licence must be changed too. Some changes are a modification with a small fee, one change is a transfer after the holder's death, and some need a fresh licence. This page explains which is which, and why the name should match your PAN, GST and trade licence first.

FSSAI Licence Name Change (Quick Answer)
To change the company or business name on an FSSAI licence or registration, log in to the FoSCoS portal, choose modification, fill Form B and upload the papers again. FoSCoS lists the modification fee as Rs 1,000 for a licence and Rs 100 for a registration. If the holder dies, guides say the legal representative should apply for a transfer within 90 days. Fix PAN, GST and the trade licence first so every name matches.

| Change | Route |
|---|---|
| Business or company name | Modification, Form B, fee |
| Owner's own name corrected | Modification with new ID proof |
| Contact details only | Modification of fields not printed on licence |
| Licence holder dies | Transfer to legal representative |
| Business sold to a new owner | Ask the officer; guides differ |
FSSAI Registration or State and Central Licence in West Bengal: The Basics
Food businesses get either a basic FSSAI registration or a licence (state or central), depending on size and type. Small sellers such as tea stalls, telebhaja shops and home bakers usually hold a registration. Bigger restaurants, sweet makers and manufacturers hold a licence.
Both are issued and changed online on FoSCoS, the Food Safety Compliance System, at foscos.fssai.gov.in. In West Bengal, the Designated Officer of the food safety department for your district looks at state licence applications.
The name printed on the licence is the name of the food business operator: a person for a proprietorship, or the firm or company.
If your licence still shows the right name and only your phone or email changed, that is a simple update of fields not printed on the licence. You do not need us for that.
How to Change the Business Name on FSSAI: Form B Modification on FoSCoS
FoSCoS guidance describes the steps: log in with your application reference, licence or registration number, open modification, fill Form B with the changes, upload the papers and state the purpose.
When you tick Company Name, Registered Office Address or Kind of Business, the whole application opens for change. FoSCoS says you must upload all documents again in every modification, so keep fresh copies ready.
For a company, bring the new certificate of incorporation from the Registrar of Companies. For a firm, bring the amended partnership deed. For a proprietor whose shop name changed, bring proof of the new trading name, such as GST or the trade licence; see trade licence name change.
FSSAI Modification Fee: Rs 1,000 for a Licence, Rs 100 for a Registration
The FoSCoS guide lists the modification fee as Rs 1,000 for a licence and Rs 100 for a registration. A consultant's guide says this applies to changes printed on the licence, and that changing only contact details or supporting papers is free. If you move up a licence category, a differential fee is added.
Guides say processing takes about 30 to 45 days, and that the Designated Officer may raise a query that you should answer within 30 days.
Pay only on the FoSCoS portal. Many private sites with FSSAI in their name charge extra for the same form.
Proprietor's Own Name Change on an FSSAI Licence After Marriage or a Spelling Error
For a proprietorship, the operator is a person. If her surname changed after marriage, or his name was spelt wrongly, the person is the same, so it is a modification with new identity proof, not a new licence.
Fix Aadhaar and PAN first; see PAN card name change. Then upload the new ID in Form B and add an affidavit linking the old and new names; see one and the same person affidavit.
A full change of name may need a gazette as supporting proof for PAN; see gazette name change in West Bengal. FSSAI itself does not ask for a gazette as a rule.
FSSAI Licence Transfer After the Holder's Death: Apply Within 90 Days
Guides say an FSSAI licence can be transferred only when the licence holder dies, and that the legal representative or a family member should apply within 90 days of the death.
Carry the death certificate, proof that you are the heir, and your own ID. If the death certificate spells the name wrongly, get the Registrar to correct it first.
Do not keep running the shop on the dead holder's licence past that period. The same change is needed on the trade licence and GST.
Food Business Sold to a New Owner: Modification or Fresh FSSAI Licence?
Sources differ here, so we say so. One guide says a sale needs a modification of the licence; another says a licence is transferable only on death, so a buyer should apply for a fresh licence.
Ask the Designated Officer in your district which route they accept before you pay. A new owner usually has a new PAN, so a fresh GST registration follows anyway; see name change in Udyam and GST.
Keep the sale deed or agreement ready, as both routes ask for proof of the change.
The Right Order: PAN, GST, Trade Licence, Then FSSAI
Food inspectors compare the names on your FSSAI licence, trade licence and GST. If they differ, every inspection and every tender starts with questions.
Change Aadhaar and PAN first, then GST, then the trade licence from KMC, the municipality or the Gram Panchayat, and then FSSAI. Each one becomes proof for the next.
Update your packaging labels too. A packed food label carries the licence number and the operator's name, and old stock with the old name should be used up or relabelled as the officer advises.
