BMSSY Labour Card and e-Shram Name Mismatch in West Bengal

Unorganised workers in West Bengal can hold two cards. The state's Bina Mulya Samajik Suraksha Yojana (BMSSY) gives a Samajik Mukti Card with an SSIN number, and pays PF, medical, education and death benefits. The central e-Shram card gives a 12-digit UAN and takes its details from Aadhaar. When a worker's name differs between the two, or from the bank passbook or nominee's papers, a claim can be held up when it matters most. This page shows how to make them agree.

BMSSY and e-Shram Name Mismatch (Quick Answer)

Make the worker's name the same on Aadhaar, the bank passbook, the BMSSY Samajik Mukti Card and e-Shram. e-Shram takes details from Aadhaar, so correct Aadhaar first. For BMSSY, ask the Labour Department office or the inspector who registered you to correct the record, with Aadhaar and passbook. Check the nominee's name too, because death and PF benefits go to the nominee. Registration is free; no gazette is needed.

BMSSY Labour Card: West Bengal's Free Social Security for Unorganised Workers

Bina Mulya Samajik Suraksha Yojana grew out of the state's Samajik Suraksha Yojana, set up by Labour Department notification No. Labr./260/(LC-LW) dated 11 October 2017. It covers unorganised wage earners and self-employed people aged 18 to 60 living in West Bengal, across many listed trades plus construction and transport workers.

The 2017 rules gave each registered worker a Samajik Mukti Card with a unique Social Security Identification Number (SSIN). Benefits include a state-assisted PF, medical help up to Rs 20,000 a year and Rs 60,000 for surgery, education grants, and Rs 2,00,000 on accidental death or Rs 50,000 on natural death.

Under BMSSY the state pays the full monthly PF contribution of Rs 55, so the worker pays nothing. Registration is online at bmssy.wblabour.gov.in.

The 2017 rules asked for a copy of the bank passbook's first page, the voter card or Aadhaar, and photographs. That is where names first enter the record.

e-Shram

e-Shram Card for Unorganised Workers Aged 16 to 59

e-Shram is the central register of unorganised workers aged 16 to 59 who are not members of EPFO or ESIC. Registration is free and needs only the Aadhaar number and Aadhaar-linked mobile. Each worker gets a 12-digit UAN, and the card does not expire.

The official FAQ says the photo is taken from Aadhaar and cannot be updated on e-Shram. Workers can update details such as address, mobile and bank on the portal or at a CSC.

A worker who later joins EPF or ESI is no longer in the e-Shram group; see ESIC records.

Aadhaar First

e-Shram Name Follows Aadhaar: Correct Aadhaar First

Because e-Shram builds the profile from Aadhaar, the name on e-Shram follows Aadhaar. If Aadhaar spells your name wrongly, correct Aadhaar at a Seva Kendra first; see name change in Aadhaar.

After Aadhaar is updated, ask at a CSC how to refresh the e-Shram profile. Aadhaar allows only two name changes in a lifetime, so do it once, carefully.

If Aadhaar is right and BMSSY is wrong, leave Aadhaar alone and correct BMSSY.

BMSSY

Correcting a Name in the BMSSY Samajik Mukti Card Record at the Labour Department

BMSSY records are kept by the Labour Department. The 2017 rules named inspectors of the Labour Commissionerate, or officers authorised by the Labour Commissioner, as registering authorities.

Go to the Labour Department office, or the facilitation point where you registered, with your Samajik Mukti Card, Aadhaar, passbook and a written request to correct the name. Keep the acknowledgement.

If only the spelling differs from Aadhaar, an affidavit can bridge it meanwhile; see one and the same person affidavit.

Nominee

BMSSY Nominee Names: Fix Them Before a Death Benefit Claim

The 2017 rules ask each worker to declare a nominee with name, relationship, age and bank details. The PF and the death benefit go to the nominee.

If the nominee's name on your form differs from her Aadhaar or bank account, the claim can stall. Update the nominee details now.

A wife added in her maiden name, whose Aadhaar now shows her married name, is one example. The marriage certificate links the two; see marriage certificate correction.

Claims

BMSSY Claims and PF Payments: Bank Account Name Must Match

Benefits are paid into bank accounts. The worker's or nominee's account holder name should match the record; see name correction in a bank account.

For a death claim, the family will need the death certificate. If the worker's name on it differs from the BMSSY record, the Registrar of Births and Deaths corrects the certificate.

No gazette is needed for any of this.
