Rent Agreements Under the West Bengal Premises Tenancy Act, 1997
Most rented homes and shops in West Bengal fall under the West Bengal Premises Tenancy Act, 1997. It sets fair rent, the duties of landlord and tenant, and who continues a tenancy after the tenant dies.
Disputes go to the Rent Controller. In districts this is usually the Sub-Divisional Officer; the Kalimpong district site, for example, names the SDO as Rent Controller.
Under the Registration Act, 1908, a lease from year to year, or for more than a year, must be registered. Many people sign an 11 month agreement for this reason, but registration is still needed when an office asks for a registered agreement.

How to Write Tenant and Landlord Names in a Rent Agreement
Write the tenant's full name exactly as on Aadhaar, with father's or husband's name as on Aadhaar too. Add the Aadhaar or PAN number only if both sides agree; a masked Aadhaar is safer.
Write the landlord's name as on the property record: the deed, mutation or municipal tax bill. If two or more people own the flat, name all of them, or attach the authority of the one who signs.

Wrong Name in a Signed Rent Agreement: Supplementary Agreement
A signed agreement cannot be edited by hand. The clean fix is a short supplementary agreement on stamp paper, signed by both sides, that says the name was written wrongly and gives the correct name. For a small spelling slip, many people simply sign a fresh agreement.
If the original lease was registered, the correction should also be registered at the same registry office.

Landlord Named in the Rent Agreement Has Died: Fresh Agreement With the Heirs
Many old tenancies name a landlord who has since died. The heirs step into the landlord's place, but offices may still ask for a current agreement.
Sign a fresh agreement with the heirs who now own the property, after they have the property mutated in their names; see property tax and municipal mutation.
If heirs fight over who should get the rent, the Act lets a tenant deposit rent with the Rent Controller when the landlord refuses it. The Kalimpong district page describes this: send by money order first, then deposit within fifteen days if it comes back.
Tenant Dies: Who Continues the Tenancy Under the 1997 Act
The Act's definition of tenant covers the tenant's spouse, son, daughter, parent and the widow of a predeceased son, if they were living with the tenant as family and were dependent on him or her.
For most of these heirs the right lasts five years from the tenant's death. The five year limit does not apply to the dependent spouse.
The surviving family should ask the landlord for rent receipts in the new name. A tenancy dispute is a lawyer's job; the District Legal Services Authority gives free legal aid to eligible people.
Rent Receipts, HRA Claim and the Landlord's PAN: Names Must Match
Under Section 4 of the Act, a landlord must issue a signed written receipt as soon as rent is received. The receipt should carry the same tenant and landlord names as the agreement.
Salaried tenants claiming House Rent Allowance usually give receipts to the employer. Income tax rules ask for the landlord's PAN when yearly rent passes Rs 1 lakh, so the landlord's name should match that PAN.
If the landlord's name on receipts differs from the agreement, ask for corrected receipts before the year ends.
Rent Agreement as Address Proof for Passport and Other Offices

Tenant Police Verification in Kolkata: Same Name as the Agreement
Many landlords in Kolkata and other towns inform the local police station about a new tenant, with the tenant's ID and agreement. Rules and forms vary, so ask your police station what it needs.
