Gold Loan Name Mismatch in West Bengal
Pledging jewellery for a gold loan is a quick source of money for many families. The lender checks the borrower's KYC and, under the Reserve Bank's 2025 gold loan directions, should not lend if ownership of the gold is doubtful. Names matter again when the gold comes back: the lender returns it to the borrower, or after a death, to the legal heirs. If the borrower's name differs between the loan papers, Aadhaar and the death certificate, getting the jewellery back can take longer. This page explains what to keep in order.

Gold Loan Name Mismatch (Quick Answer)
For a gold loan, the borrower's name should match on Aadhaar, PAN and the bank account linked to the loan. Guides on the Reserve Bank's 2025 directions say lenders must not lend if ownership of the gold is doubtful, and must return pledged gold within 7 working days of full repayment, paying Rs 5,000 a day for delay. If the borrower dies, the heirs claim the gold with the death certificate and heir proof; if the name on the death certificate differs from the loan record, correct it or give an affidavit.

Gold Loan Rules in West Bengal Under the RBI 2025 Directions
Banks and gold loan companies lend against jewellery. The Reserve Bank issued fresh directions on loans against gold and silver in 2025. A legal guide says they are fully effective from 1 April 2026, and loans sanctioned before that remain under the earlier rules.
The same guide lists loan-to-value limits of 85 percent up to Rs 2.5 lakh, 80 percent from Rs 2.5 lakh to Rs 5 lakh, and 75 percent above that.
For the borrower, two moments need clean names: taking the loan, and getting the gold back.
Check the pledge receipt. It carries the borrower's name, the weight and a description of each item. Keep it safe.
Gold Loan KYC: Aadhaar, PAN and Bank Account Names Must Match
The lender takes KYC, usually Aadhaar and PAN, and links the loan to a bank account. If your Aadhaar and PAN spell your name differently, fix that first; see PAN and Aadhaar mismatch.
The bank account that receives the loan should be in the same name; see name correction in a bank account.
For a small spelling difference, ask the lender whether it accepts an affidavit; see one and the same person affidavit.
Ownership of Pledged Gold: Inherited and Wedding Jewellery in Another Name
A guide on the new directions says loans cannot be sanctioned if ownership of the gold is doubtful, and lenders must verify before lending.
Jewellery is often received at a wedding or inherited from a mother or grandmother, with no bill. The lender may ask you to declare that you own it. Be truthful: if the jewellery belongs to a family member, they may need to be the borrower.
If a bill or gift paper exists in a maiden name or an old spelling, carry proof linking it to your current name.
Gold Return Within 7 Working Days of Repayment, Rs 5,000 a Day for Delay
The legal guide says lenders must return pledged items within 7 working days of full repayment, and pay compensation of Rs 5,000 per day for any delay.
The lender returns the gold to the borrower named on the loan, after checking ID. If your name changed after the loan, carry proof of the change.
Check each item against the pledge receipt before you leave the counter.
Gold Loan After the Borrower Dies: How Legal Heirs Claim the Gold
When a borrower dies, the heirs generally settle the loan and claim the gold. The lender asks for the death certificate, proof of who the heirs are, and their own ID.
If the name on the death certificate differs from the loan record, correct the death certificate through the Registrar that issued it, or give an affidavit linking the names.
The guide says the directions also cover gold not claimed within two years of repayment, with lenders required to try to trace borrowers or heirs. Disputes between heirs are a lawyer's job; the District Legal Services Authority gives free legal aid to eligible people.
Gold Loan Auction Notices: Two Newspapers and Your Name
If a loan is not repaid, the lender can auction the gold. The legal guide says auctions must be announced in at least two newspapers, one regional and one national, with a reserve price of at least 90 percent of current value.
The lender also sends notices to the borrower. Keep your address and mobile updated in the loan record, in your correct name, so you receive them.
Any surplus after the auction must be returned to the borrower within 7 working days, the guide says.
Gold Loan in Maiden Name: Women Borrowers With a Changed Surname
A woman who pledged jewellery under her maiden name and later changed her surname should update KYC with the lender, with the marriage certificate.
Otherwise, carry the marriage certificate when collecting the gold; see Aadhaar name change after marriage.
The same proof helps with bank accounts and other loans.
