Cheque Payee Name Mismatch in West Bengal
A cheque made out to "Rupa Sen" when your account says "Rupa Sengupta", a refund cheque in your maiden name, an insurance cheque with your father's name misspelt: these are everyday problems at West Bengal bank branches. An account payee cheque can be credited only to the account of the person named on it, so the branch has to decide whether the name on the cheque and the name on your account are the same person. This page explains when banks accept a small difference, when they will not, and the faster ways round it.

Can I Deposit a Cheque With a Different Name? (Quick Answer)
An account payee cheque is credited only to the account of the named payee. For a small spelling difference, many branches accept it if your account records show the link, sometimes with a letter or indemnity; that is the branch's decision. For a different surname or a maiden name, update your account to show both names, or ask the issuer to reissue the cheque or pay by bank transfer. A gazette is rarely needed.
| Situation | Usual fix |
|---|---|
| Small spelling slip in the payee name | Ask the branch; letter or indemnity if it agrees |
| Cheque in your maiden name, account in married name | Show the link at the branch, or ask for reissue |
| Cheque in initials, account in full name | Usually accepted if the rest matches; ask |
| Cheque in the name of someone who has died | Not deposited into another account; heirs claim or issuer reissues |
| Cheque issuer used Positive Pay with a different name | Issuer corrects Positive Pay or reissues |
The Account Payee Rule: Credit Only to the Named Payee
Most cheques today are crossed "account payee". Banks may credit such a cheque only to the account of the person named as payee, and should not collect it for anyone else. A bank's cheque collection policy of 2025, for example, says banks should not collect account payee cheques for a third party.
So the question at the counter is not whether the money is yours. It is whether the payee on the cheque is the account holder. If the names differ, the branch must be satisfied they are the same person.
That judgement is the branch's. Two branches of the same bank may decide differently. Ask before you deposit, not after the cheque comes back.
Small Spelling Differences on a Cheque
A cheque to "Sourav Mukherji" for an account in the name "Sourav Mukherjee", or to "S. K. Das" for "Sanjoy Kumar Das", is often accepted when the rest is clear. Some branches ask for a short letter or an indemnity from you.
If the branch refuses, it is not breaking a rule; it is protecting you and itself. Ask the issuer to reissue the cheque in the exact account name, or to pay by NEFT or IMPS.
To avoid this in future, give anyone who pays you your name exactly as on your bank account, letter for letter.
Cheque in Your Maiden Name After Marriage
After marriage, insurance refunds, old dividend cheques and family gifts often come in the maiden name, while the account has the married name. A different surname is too big a gap for most branches to accept on sight.
If your account record shows both names, many banks accept the cheque with proof such as the marriage certificate. Ask your branch whether it will record your former name; see bank account name change after marriage.
Where the branch will not accept it, ask the issuer to reissue in your current name or pay by transfer. A one and the same person affidavit helps the issuer agree; see one and the same person affidavit.
Cheque in the Name of Someone Who Has Died
A cheque made out to a person who has since died cannot simply be deposited into a family member's account. The payee no longer holds an account to credit, and the heirs are not the payee.
Usually the issuer, such as an insurer, a pension office or a company, cancels the cheque and pays the nominee or legal heirs through its own claim process. If the deceased's account is still open, the bank may credit it while the claim is settled; ask the branch.
Where names on the death certificate and the claim papers differ, link them by affidavit. For court papers for heirs, see succession certificate name mismatch.
Faster Cheque Clearing and Positive Pay
From 4 October 2025 RBI's continuous clearing put cheques through the Cheque Truncation System within hours on the same day, instead of one to two working days, with a second phase scheduled from January 2026. Faster clearing also means a name problem is found faster.
Under the Positive Pay system, the issuer of a large cheque sends the bank the account number, cheque number, date, amount and beneficiary name in advance. Reports say it is advised above Rs 50,000 and required by banks above Rs 5 lakh. If the beneficiary name in Positive Pay differs from the cheque, it can be rejected.
If a large cheque to you is returned, ask the issuer to check what name they entered in Positive Pay.
If You Issue Cheques: Write the Payee Name Right
When you write a cheque, copy the payee's name from their bank account or cancelled cheque, not from memory. Use full names, not nicknames or initials.
Do not overwrite or correct a payee name on a cheque. Alterations to the payee name are a common reason for return; write a fresh cheque instead.
If you have changed your own name, your signature on file may also need updating; old cheque leaves still clear against the same account, but ask your branch about a new cheque book in the new name.
