Form 16 and Form 26AS Name Mismatch in West Bengal

Every rupee of tax cut from your salary, interest or rent is credited to your PAN, and it shows in your tax statement only if the person who deducted it quoted your PAN correctly. A name spelt differently on Form 16 is usually harmless. A wrong PAN, or a PAN that has become inoperative because it is not linked to Aadhaar, is not. This page explains which mismatch matters, who corrects it, and what changes now that the Income-tax Act, 2025 has renamed these forms from April 2026.

Does a Name Mismatch on Form 16 or 26AS Matter? (Quick Answer)

TDS is credited to your PAN, so a different spelling of your name on Form 16 usually does not stop the credit. What matters is that the PAN is right and operative. If tax was deducted under a wrong PAN, only the deductor, your employer or bank, can fix it by filing a correction statement. For income from 1 April 2026, Form 16 is Form 130 and Form 26AS is Form 168.

How It Works

How TDS Reaches Your PAN and Your Tax Statement

When your employer, bank or tenant cuts tax at source, they deposit it and file a quarterly TDS return listing each person's PAN and the amount. The Income Tax Department matches each entry to the PAN and shows it in your annual tax statement, Form 26AS, and in the Annual Information Statement.

Form 16 is the certificate your employer gives you for salary TDS; Form 16A is the one banks and others give for non-salary TDS. Both are generated from the deductor's TDS return.

So the key is the PAN in the deductor's return. The name is printed from the deductor's or the department's records, but the credit follows the number.

Name Only

Name Spelt Differently on Form 16 but PAN Is Correct

If your Form 16 shows "Sourav Banerjee" and your PAN says "Saurav Bandyopadhyay", but the PAN number is right, the tax credit still reaches you. You can file your return and claim it.

Still, tell your employer's HR or payroll team, and give them your PAN and Aadhaar so the name is right next year. Payroll names often come from an old joining form.

For a Bengali surname written two ways across documents, see Bengali and English name mismatch.

Wrong PAN

Tax Deducted Under a Wrong PAN: Only the Deductor Can Fix It

If a digit in the PAN is wrong, the TDS goes to someone else's PAN, or to none, and does not appear in your 26AS. You cannot claim it in your return until it shows.

Only the deductor can correct it, by filing a correction statement for that quarter's TDS return on the department's TRACES system. Ask your employer, bank or tenant in writing, give them your correct PAN, and keep a copy.

Once the correction is processed, the credit appears in your 26AS. If the deductor does not act, you can raise a grievance with the Income Tax Department.

Inoperative PAN

Inoperative PAN, Higher TDS and the Aadhaar Name Match

A PAN not linked with Aadhaar by the deadline becomes inoperative. Tax can then be deducted at a higher rate, and refunds can be held up.

Linking often fails because the names on PAN and Aadhaar do not match. Fix whichever one is wrong, then link; see PAN and Aadhaar name mismatch and name correction in PAN card.

After linking, tell your employer and bank, so they stop deducting at the higher rate.

Income-tax Act 2025

New Form Numbers Under the Income-tax Act, 2025

The Income-tax Act, 2025 came into force on 1 April 2026, with new form numbers. As reported, Form 16 becomes Form 130, Form 16A becomes Form 131, Form 26AS becomes Form 168, and the quarterly TDS returns Form 24Q and 26Q become Form 138 and Form 140.

Reports say the purpose and contents of the forms stay the same. Certificates for earlier years keep their old names, so you may see both for a while.

The rule on names does not change: credit follows the PAN. Keep your PAN right and linked, and the form number does not matter.

After Marriage

Name Change After Marriage: PAN First, Then Employer and Bank

If you change your surname after marriage, the PAN number stays the same; only the name is corrected. See PAN card name change after marriage.

Then give your employer and banks the updated PAN and Aadhaar, so payroll, Form 16 and interest certificates carry the new name.

For other employee records that read the same name, such as the provident fund, see EPF and UAN name correction.
