Partition Deed Name Mismatch in West Bengal
When brothers, sisters and cousins in West Bengal divide a family house or land, they sign a partition deed. Every co-sharer must be named, and every name must link back to the khatian or old deed. Often the khatian shows a grandfather, sisters now carry married surnames, or a cousin's Aadhaar is spelt differently. A missing or mismatched name can stop mutation later and reopen the whole partition. This page shows how to get the names right.

Partition Deed Name Mismatch (Quick Answer)
A partition deed in West Bengal must name every co-sharer, including married sisters and the heirs of anyone who has died, each as on their current Aadhaar. Add a recital linking each name to how the khatian or old deed shows it, backed by a one and the same person affidavit where spellings differ. Register the deed, then apply for mutation of each separated share. A wrong name after registration needs a rectification deed signed by all parties.

| Problem | Fix |
|---|---|
| Khatian still in a grandparent's name | Heirs named with a recital of the chain |
| Sister's surname changed after marriage | Current name plus recital and affidavit |
| Co-sharer left out | Partition can be challenged; include all |
| Cousin's Aadhaar spelling differs | Write as on Aadhaar, link by affidavit |
| Wrong name found after registration | Rectification deed signed by all |
Partition of Family Land in West Bengal: Registered Deed or Court
For raiyati (agricultural) land, Section 14 of the West Bengal Land Reforms Act, 1955 is read by Kolkata lawyers to say that a holding can be partitioned among co-sharers only by a registered instrument or a court decree. An oral family arrangement does not do it.
The same reading says that if any share falls below the standard area after partition, the shares may be recast, and land that cannot be divided may have to be sold, first to co-sharers.
For houses and flats in towns, a registered partition deed is also the normal way to divide ownership.
Either way, the deed is the document every later office will read. So the names in it matter.
Who Must Be a Party to a Partition Deed in West Bengal
Every person who owns a share must be a party: all recorded co-owners, and if one of them has died, all of that person's legal heirs.
Leaving someone out is the most serious name mistake. A co-sharer who was not a party is not bound by the deed and can challenge it later. That is often a sister or a cousin living outside West Bengal.
If heirs disagree on shares, that is a lawyer's job. The District Legal Services Authority gives free legal aid to eligible people.
Khatian Name vs Aadhaar Name: Linking Co-Sharers in a Partition Deed
The khatian or old deed may show a grandfather or father. The partition deed should set out the chain in a recital: who the recorded owner was, when he or she died, and who the heirs are, each named as on current Aadhaar.
Where a co-sharer's name in an older record is spelt differently, add a line linking the two, and keep a sworn affidavit; see one and the same person affidavit. The same recital idea is explained in gift deed name mismatch.
If the khatian itself is wrong, consider correcting it first; see mutation and name correction on Banglarbhumi.
Married Sisters and Daughters in a Partition Deed: Maiden and Married Names
Daughters, including married daughters, are heirs to a parent's property under the Hindu Succession Act, 1956. Many families still forget to include them, or include them under a maiden name no longer on their ID.
Name each sister as on her current Aadhaar, and add "daughter of" the recorded owner, with a recital that she is the same person named under her maiden name in older papers. See Aadhaar name change after marriage.
If a sister wants to give up her share, that is done by a release or relinquishment in her current name, not by leaving her out.
Minor Co-Sharers in a Partition Deed: Names and Guardians
If a co-sharer is a child, a guardian acts for the child. For a minor's land or house, the law may require court permission before a guardian can deal with it.
Write the child's name as on the birth certificate or Aadhaar, and the guardian's name as on the guardian's ID. Take legal advice before signing; a partition that is unfair to a minor can be challenged later.
This is one case where saving money on a lawyer is a false saving.
Wrong Name in a Registered Partition Deed: Rectification Deed
A registered partition deed is not edited. A wrong name or wrong share is fixed by a deed of rectification, signed by all parties to the original deed, and registered.
If one party has died or will not sign, rectification may need a civil court. For a small spelling slip, an affidavit with ID may be enough for mutation; ask the BL&LRO or municipality.
For older deeds in old names more generally, see name change in property documents.
Mutation of Each Share After Partition: BL&LRO for Land, Municipality for Houses
Lawyers answering public questions on West Bengal partitions advise doing mutation after the partition deed is registered, not before, so it is done once.
Each co-sharer then applies for mutation of his or her separated share: at the BL&LRO for land, and at the municipality for a house or flat; see property tax and municipal mutation.
The name in each mutation application should match the partition deed and Aadhaar.
Partition Deed Stamp Duty in West Bengal: What Lawyers Say
Advocates answering on a public legal forum put West Bengal stamp duty on a family partition at 0.5% of the market value of the separated share or shares, with registration fees on top.
On one thread an answer first said 2%, and other advocates corrected it to 0.5%. We could not find the official schedule ourselves, so confirm with the e-Assessment on wbregistration.gov.in or the Sub-Registrar before you pay.
Fees depend on the market value the registry assesses, not the value written by the family.
