Housing Board and HIDCO Flat Allotment Name Mismatch in West Bengal

Flats and plots from the West Bengal Housing Board, WBHIDCO and development authorities are allotted by lottery or application, in the applicant's name. That name then runs through the allotment letter, the lease or sale deed, the New Town (NKDA) or municipal mutation, and the tax bill. If your PAN, Aadhaar and bank showed different spellings when you applied, or the allottee has died, each step can stall. This page shows which office fixes what.

Housing Board and HIDCO Allotment Name Mismatch (Quick Answer)

For a Housing Board or HIDCO allotment in West Bengal, the allottee's name must match PAN, Aadhaar and bank when you apply, because a lottery allotment is hard to change later. After allotment, the lease or sale deed and the NKDA or municipal mutation follow that name. Explain small spelling gaps with a one and the same person affidavit. If the allottee dies, heirs apply with a legal heirship certificate; a society nominee only holds the flat for the heirs.

The Basics

Who Allots Government Flats and Plots in West Bengal: WBHB, HIDCO and Development Authorities

Three kinds of body allot homes in West Bengal. The West Bengal Housing Board (WBHB) builds and allots flats. WBHIDCO allots plots and flats in New Town and in newer townships. District development authorities, such as the Burdwan Development Authority, allot flats in their areas.

In New Town, the New Town Kolkata Development Authority (NKDA) keeps the record of title (mutation) after allotment. Its mutation page lists allotment letters from WBHIDCO or WBHB among the papers.

Each body keeps its own allottee file. A name fixed in one place does not change itself in the others.

So the order matters: allotting body first, then the deed, then mutation, then tax.

Before Applying

Match PAN, Aadhaar and Bank Names Before Applying for a WBHB or HIDCO Flat

For WBHIDCO's 2024 lottery of 99 year lease plots in Gitabitan Township, Santiniketan, a news report lists Aadhaar, PAN, income proof and three months of bank statements among the papers, with the application made online at wbhidcoltd.com.

If your PAN, Aadhaar and bank account spell your name differently, fix them before you apply. Once a lottery is won in one spelling, changing it later can mean letters and affidavits at every step.

For PAN and Aadhaar gaps, see PAN and Aadhaar name mismatch.

Allotment Letter

Wrong Name on a WBHB or HIDCO Allotment Letter: Write to the Estate Section

If the allotment letter has a typing error, write to the allotting office (the estate or allotment section of WBHB, WBHIDCO or the development authority) at once, with a copy of your application and ID proof. Ask for a corrected letter or a written note on file.

If the gap is only Bengali and English spelling, or an initial versus a full name, a sworn affidavit usually explains it; see one and the same person affidavit.

Do this before the lease or sale deed is registered. A registered deed is history and is not rewritten easily.

Deed and Mutation

Lease Deed, Sale Deed and NKDA Mutation Names in New Town

After allotment comes a registered lease deed or sale deed. In New Town, you then apply to NKDA for mutation (record of title). NKDA's page lists the allotment letter, possession letter, sale or lease deed and the NKDA occupancy certificate among the papers.

NKDA's page gives the mutation fee as 0.5% of the deed value for the first transfer from HIDCO or WBHB. Outside New Town, the municipality does the mutation; see property tax and municipal mutation.

Make sure the name on the deed and the mutation record matches the allotment letter. For older deeds in an old name, see name change in property documents.

After Marriage

Allottee's Surname Changed After Marriage: Updating the Allotment

Many allotments were made before marriage. The allotment and deed stay in the old surname, while Aadhaar and PAN now show the new one.

The deed is not rewritten for this. An affidavit that both names are the same person, with the marriage certificate, usually bridges the gap for mutation, tax and bank loans. See Aadhaar name change after marriage for the ID side.

If you are a government employee, the rules for your service record are different and need only an intimation for a surname change on marriage.

Inheritance

Allottee Has Died: NKDA and Development Authority Heir Rules

For New Town, NKDA's mutation page lists the death certificate, a legal heirship certificate from a First Class Judicial Magistrate, and an heirship and residential certificate from the local representative for inheritance cases. It gives the fee as 0.25% of the property value.

The Burdwan Development Authority's guidelines for flats ask for an affidavit listing all surviving heirs, an indemnity bond, and a relinquishment deed from heirs who are not applying.

Each heir's name in these papers should match that heir's own ID. Disputes among heirs are a lawyer's job; the District Legal Services Authority gives free legal aid to eligible people.

Nominee

Society Nominee or Legal Heir: Who Gets the Flat?

Many government flats are run by a cooperative society. A society nomination lets the flat be moved quickly, but it does not make the nominee the owner.

A Kolkata advocate's note cites the Supreme Court in Indrani Wahi v. Registrar of Cooperative Societies, which let a nominee receive the transfer without a succession certificate, and a Calcutta High Court ruling that the nominee holds the flat until title is settled among the heirs.

So a nominee's name on the society record is not the end of the matter if other heirs exist. Take legal advice before selling.

Transfer Limits

Selling or Transferring an Allotted Flat or Plot: HIDCO Permission and Lock In

Allotted homes often come with conditions. NKDA's page says a lessee in New Town may apply for mutation on permission from HIDCO, which shows a lease transfer needs the lessor's permission.

Read your allotment letter and lease for lock in periods and transfer conditions before you agree to sell. A name correction does not remove those conditions.

For buyers: check that the seller's name on the allotment, deed and mutation all match before paying.
